     Will.m Robinson
 Command was given to the Sherr of Somersett County that he should
take William Robinson Late of Somersett County Planter if he
Should be found in his Bailywick and him Should safe Keep so that
       he might have his body before the Justices of his Lordships County Court of Somersett
       to be help at Dividing Creek the third tuesday of august ^then next^ to answer unto Thomas
       Dashiel of a plea of trespass upon the Case &c and that thereof he Should not faile &c

             And the Said Thomas Dashiell by Levin Gale his attorney declared against the afd
       William Robinson in the plea afd as followeth vizt

       Somersett fs
                               William Robinson Late of All hollows parish in Somersett County planter
       was attached to answer unto Thomas Dashiell of a plea of trespass upon the Case &c

                   And whereupon the same Thomas by Levin Gale his attry Complains that whereas
       ye s.d W.m Robinson the twentieth day of June one thousand seven hundred & twenty six at ye
       County afd within y.e Jur of this Court was Indebted unto the said Thomas in ye sum of one
       thousand one hundred & seventy seven p.ds of tob.o as by an acc.t here within Court produced
       may appear and so thereof being Indebted the afd W.m in Consideration thereof afterwards to
       witt the same day and year afd at the County afd within the afd Jur upon himselfe assumed
       & to the same Thomas then & there faithfully promised that he when afterwards he should be
       there^un^to Required he the s.d sum of one thousand one hundred and seventy seven pd.s of tob.o
       to the same Thomas would well & faithfully Content & pay nevertheless ye s.d W.m his promise and
       assumption afd in form afd made Little regarding but Plotting & fraudulently Intending the same
       Thomas in that part to defraud & deceive the s.d W.m the s.d sum of one thousand one hundred and
       seventy seven pounds of tob.o or any part thereof hither to to ye same Thomas (altho' often by the
       same Thomas thereto required afterwards viz.t the same day & year afd at the County afd within
       the afd Jurisdiction) hath not paid or the s.d Thomas for it in any wise Contented but the afd
       W.m the same hitherto to pay or the same Thomas for it in any wise to Content hath altogether
       refused & Still Doth refuse whereby the Same Thomas Says he is worse & hath damage to
       the value of two thousand three hundred & fifty four pd.s of tob.o & thereof he brings this Suite &c
