                     John Neasam Late of Somersett County Planter als dicts
John Neasom of the County afd Planter was sumoned to
answer unto Mary Martin Exrx of the Last will & testament
of Rob.t Martin dec.d of a plea that he render unto her One
        thousand four hundred & four pounds of tob.o which from her he unjustly
        detaines &c                      And whereupon the Same Mary by Levin Gale her
       Attorney Complaines that whereas the afd John the twenty Eight day of July
       Anno Dom: one thousand Seven hundred & twenty four at Somrsett County
       afd within the Jur of this Court by his Certain Writing Obligatory which the
       same Mary signed with the Seal of the Same John hereinto Court brings
       Granted himselfe to be held & firmly Bound unto the afd Robert in his
       Lifetime in ye Sum of One thousand four hundred & four pounds of tob.o
       To be paid ye same Rob.t his Ex.rs adm.rs or assigns when afterwards ye Said John
       should be thereto requested yett the afd John though ^often^ therto required the afd Sum
       of one thousand four hundred & four pounds of tob.o to the afd Robert in his Lifetime
       Nor ye afd Mary Since his Death hath Not rendered but ye same John ye Same
       Hitherto to Doe hath altogether Denyed & Still Doth Deny to the Damage of
       of the Same Mary three thousand pounds of tob.o & thereof She brings this Suite &c
       And the same Mary brings hereinto Court the Letters Testamentary &c by which &c
                                                                      L Gale P Quer pledges &c    J: Doe  R Roe

       And the afd John Neasam in his Own proper person Cometh and defendeth the force and
       Injury when &c and says that he Cannot gainsay the action afd of the afd Mary Martin Exrx as afd
       nor but that he detaineth from her the afd one thousand four hundred and four pounds of tobo
       in manner and form as the Same Mary above against him hath Declared &c

      Therefore it is Considered by the Justices here the Sixteenth day of August Anno Dom One thousand
       seven hundred and twenty Six that the afd Mary Martin Exrx as afd recovered against
       the afd John Neasom as well the Sum of One thousand four hundred and four pounds of tobo
259   her debt afd as also the Sum of Two hundred and fifty Nine                           pounds of tobo
       for her damages which She Sustained by As well by Occasion of the detaining that same debt
       as for her Costs and Charges by her about her Suite in that part Expended to the Same Mary
       by the Court here of her assent adjudged and the afd Deft in Mercy &c


          Whereupon the afd Jno Neasam appears and thereupon the said John Neasam at the prayer of the
       plfts attorney is adjudged to give Speciall Bail to the action afd thereupon Jos MaClester of Somrsett
       County present in Court undertakes for the said Jno Neasam that if in Case the said Mary Martin should recover
       Judgmt in ye plea afd agt the said Jno Neasom or that ye said John Neasam shall be therein Convict that then he the said
       John Neasom shall pay ye Condemnation of the Court thereupon or render his Body to the Custody of ye Sherr of Somrsett
       County in satisfaction thereof or that he ye said Jos MaClester will do it for him      this Bail paid Should have
       been Entered at ye foot of ye foregoeing decl but omitted and Entered here &c
