Creditts of Thomas Layfield Late of Somrsett County Gent if they Shall be found in your Bailywick to ye value of four thousand three hundred & Seventy Eight pounds of tob.o and when you have ye same attached or any part thereof ye Same in your Costody Safe Keep so that you have ye Same Before the Justices of our County Court of Somrsett to be held at Dividing Creek ye third tuesday of August Next to Satisfie unto Jos: McClester as well ye Sum of three thousand Six hundred & Eighty One pounds of tob.o Certain Damages Recovered against him before the Justices of Our Said Court as also the sum of four hundred & thirty six pounds of tob.o Costs of Suite whereof he is Convict as all Costs accrewing upon this Our writt of attachm.t (then & there to be Condemned according to Law) & yt by good & Lawfull Men of your Bailywick you make Known unto the person or persons in whose hands you Make ye same attachm.t yt he She or they be & appear before ye Justices of Our Said County Court to be held as afd to Shew Caus if any he She or they have why the Same goods Chattles Rights or Creditts so attached in his her or their hands Ought not to be Condemned & Execution thereof had & Made according to the form of ye act of assembly in Such Case made & provided if to him her or them it shall seem mete & how you shall Execute this Writt that you make Known unto our Said Justices at ye same day & place afd & have you then & there this writt Wittness Samuell Hopkins Gent Chief Justices of our Said Court &c Att which said third tuesday of August to witt the Sixteenth day of the same month anno Dom One thousand seven hundred and twenty six being the day of the return of the Said Writt Cometh the said Joseph MccClester by his attorney afd and the Sherr of Somersett County to whom the foregoeing writt was directed Likewise Comes and makes return thereof Endorsed viz.t By virtue of ye within Writt to me Directed I Certifie yt I have attached Nine pounds fifteen shill.s in Cash of the Money of ye within Named Thomas Layfield which s.d Mony I have in my hands ready to satisfie ye within Named Jos: McClester in part of his Debt & Cost within Mentioned but Could nott find any More goods or Chattles whereon I Could Levy ye residue so answers Fran: Allen sher Whereupon the afd Joseph MccClester by his attorney afd prays that the afd sum of Nine pds fifteen Shillings in Cask so as afd attached as of the rights and Creditts of the afd Thomas Layfeild may be Condemned in the hands of the afd Francis Allen towards satisfying unto the afd Joseph McClester as well the Sum of four thousand three hundred and Seventy Eight pounds of tobo as also the Costs accrewing upon this our writt of attachment Therefore it is Considered by the Justices here the Sixteenth day of August Anno Dom One thousand seven hundred and twenty six afd that the afd Nine pounds fifteen Shillings Cash so as afd attached be Condemned in the hands of the said Francis Allen as of the rights and Creditts of the afd Tho' Layfeild towards satisfying unto the afd Joseph McClester his damages & Costs afd and that the said Joseph McClester have thereof his Ex.n against the said Francis allen according to act of assembly &c |
