seven hundred and twenty Six that the afd Mary Martin Exrx of the same Robert Martin Recover
against the afd Jacob Crouch as well the Sum of Eleven hundred and thirty four pounds of tob.o her
Debt afd as also the sum of Two hundred & Twenty four                        pounds of tobacco for her
(224)   damages which she Sustained as well by Occasion of the detaining the same Debt as for her Costs and
Charges by her about her suite in that part Expended by to the Same Mary by the Court here of her assent
adjudged and the afd Deft in Mercy &c

                         William Pepper late of Somersett County Planter was attached
to answer unto Thomas Fletcher of a plea of trespass upon the Case &c
And whereupon the same Thomas by Levin Gale his attry Complains y.t whereas
       the afd W.m the tenth day of aug.t Ann.o Dom one thousand Seven hundred & twenty five at Somrsett
    County within the Jur of this Court was Indebted unto the afd Thomas in the sum of two thousand
seven hundred & forty four pounds of tob.o as by acc.o herewithin Court produced may appear & so thereof
being Indebted to the same W.m in Consideration thereof afterwards to witt the same day & year afd at y.e
County afd within the afd Jur upon himselfe assumed to the same Thomas then & there faithfully
promised that he when afterwards he should be there to requested the afd sum of two thousand seven
hundred & forty four pounds of tob.o to the same Thomas would well & faithfully Content & pay
Nevertheless the s.d W.m his promise & assumption afd in form in form afd mad Little regarding but
Plotting & fraudulently Intending the afd Thomas in that part to Defraud & Deceive he the s.d W.m
the afd sum of two thousand seven hundred & forty four pounds of tob.o or any part thereof to the same
Thomas (altho' afterwards to witt the same day & year afd at the County afd within y.e afd Jur he
was thereto requested) he hath not paid nor the same W.m for it in any wise Contented but ye same W.m
hither to to do hath altogether refused and still doth Refuse to y.e Damage of the same Tho.s
of five thousand four hundred and Eighty Eight pounds of tob.o and thereof he brings this suite &c

    And the afd William Pepper in his Own proper person Cometh and defendeth the force and
Injury when &c and Says that he Cannot gainsay but that he did upon himselfe assume in manner
and form as the afd Thomas above against him hath declared nor ^can he say^ but that the afd Thomas Ought to
recover his damages by Occation of premisses afd to two thousand Seven hundred and forty four pds
of tob.o and Costs of Suite against him which the Said plft doth not gainsay

            Therefore it is Considered by the Justices here the Sixteenth day of August One thousand Seven
hundred and twenty Six afd that the afd Thomas Fletcher Recover against the afd William Pepper as
well the Sum of two thousand Seven hundred and forty four pounds of tobo his Damages afd in form
307    afd Confesed as also the Sum of Three hundred & Seven                           pounds of tobo by
the his Costs and Charges by him about his Suite in that part Expended to the Same Thomas by the
Court here of his assent adjudged and the afd deft in Mercy &c
