166 when &c and Says that he Cannot gainsay the Plft her action afd nor Can he Say but that the writing Obligatory afd is his act and deed and that the debt therein Mentioned is yett due and unsatisfyed wherefore the said Plft prays Judgm.t for her debt afd and her Costs and damages sustained by Occasion of the detaining of the same debt to her to be adjudged &c Therefore it is Considered by the Justices here the Sixteenth day of August anno Dom One thousand Seven hundred and twenty six that the afd Mary Martin Exrx of the said Robert Martin dec.d ^recover ag.t the afd Charles Young^ as well the Sum of two thousand four hundred and sixty two pounds of tobo 359 her debt afd as also the sum of three hundred & fifty Nine pounds of tobo for her damages which she sustained as well by occasion of the detaining of the same debt as for her Costs and Charges by her about her suite in that part Expanded to the same Mary of her assent by the Court here adjudged &c and the afd deft in Mercy &c
from her he unjustly Detains &c And Whereupon the same Mary by Levin Gale her attorney saith that whereas the afd Jacob the thirtieth day of May Ann Dom one thousand seven hundred & twenty four at Somersett County afd within the Jur of this Court by his Certain writing obligatory which the same Mary sealed with the seal of the s.d Jacob hereinto Court brings granted himselfe to be held and firmly bound unto the afd Robert Martin in his Life time in the afd sum of Eleven hundred & thirty four pounds of tob.o to be paid the same Rob.t his Ex.rs admrs or assignes when after^wards^ the s.d Jacob should be thereto required yet the afd Jacob tho' often thereto required the afd sum of Eleven hundred & thirty four pounds of tob.o to the same robert in his Life time or the afd Mary since his Death hath not rendred but the said Jacob the same hitherto to do hath altogether Denyed & Still doth Deny to ye Damage of the same Mary three thousand pounds of tob.o & thereof she brings this Suite &c & the same same Mary brings hereinto Court the Letters testamentary &c by which &c L Gale P Quer pledges &c J Doe R Roe And the said Jacob Crouch in his Own proper person Comes and defends the force and Injury when &c and says that he Cannot gainsay the action afd nor but that the writing Obligatory afd is his act and deed nor but that he Owes the afd Mary the afd Eleven hundred and thirty four pounds of tobacco as the afd Mary by her declaration afd against him hath declared &c Therefore it is Considered by the Justices here the Sixteenth day of August anno Dom One thousand (Seven) |
