1726 165 whereupon for that it Seems to the Court here that the afd Thomas Predix hath Complyed with the Law as alledged Therefore it is Considered by the Justices here the Sixteenth day of August anno: Dom One thousand Seven hundred and twenty Six that the afd Thomas Predix recover against the afd William Smith as well the afd sum of four pounds three Shillings and Six pence Curr.t mony 217 his damages by Occasion of the premisses afd as also the Sum of Two hundred and Seventeen 217 pounds of tob.o by the Court here adjudged unto him for his Costs and Charges by him about his Suite in in this behalfe Laid Out and Expended by way of attachm.t against the goods Chattells and Creditts of the Said W.m Smith according to act of assembly in Such Case made and provided &c
dec.d of a plea that he render unto her two thousand four hundred and sixty two pounds of Merchantable tobacco which from her he unjustly detains &c And whereupon the Same Mary Martin by Levin Gale her attorney Saith that whereas the afd Charles the fifteenth day of July ann.o Dom One thousand Seven hundred and twenty four at somersett County within the Jurisdiction of this Court by his Certain writing Obligatory which the same Mary sealed with the seal of the Same Charles hereinto Court Brings granted himselfe to be held and firmly bound unto the afd Robert in his Lifetime in the afd Sum of two thousand four hundred and sixty two pounds of tob.o to be paid the Same robert his Executors adm.rs or assigns when afterwards he should be thereto required yett the afd Charles tho' often thereto required the afd sum of two thousand four hundred and Sixty two pounds of tobo to the Same robert in his Lifetime or the afd Mary since his death hath not rendered but the Said Charles the Same hitherto to do hath altogether denyed and still doth deny whereby the Same Marty says She is worse and hath damage to the value of three thousand pounds of tobo & thereof She brings this Suite &c and the Same Mary brings hereinto Court the Letters Testamentary &c by which &c L Gale P Quer Pledgs &c Jno Doe R Roe Whereupon the said Charles Young being Called appears and thereupon the said Charles Young att the prayer of the plfts attorney afd is adjudged to give Speciall Bail to the action afd Thereupon a Certain Joseph Bounds and John Esome both of Somersett County planters present here in Court undertakes for the said Charles Young that if in Case the said Mary Martin shall recover Judgm.t in the plea afd against the said Charles Young or that the said Charles Young shall be therein Convict that then he the Said Charles Young shall pay the Condemnation of the Court thereupon or render his Body to the Custody of the Sherr of Somersett County in satisfaction thereof or that they the said Joseph bounds & Jn.o Esome will do it for him &c And the said Charles Young in his Own proper person Comes and defends the force and Injury (when) |
