162 of this Court at & upon a Certain Lewis Jones in ye Peace of god & ye Lord Proprietary then & there being An Assault did make & him did Beat wound & Evilly treat So that of his Life it was dispair'd & Other harms to him y.e S.d Lewis then & there did doe to his Great Damae & Against ye Peace &c whereof ye same Levin for y.e S.d Lord Proprietary prays Advisement thereof ye Court upon ye Premisses &c & yt due Process of Law may Issue &c Thereupon Command was given to the Sherr of Somersett County that he should take the said William Roberts and being by the Sherr Sett to the Bar is thereupon Instantly demanded how he would acquitt himselfe if the premisses afd says that of the premisses afd he is no ways guilty thereof and thereof for tryall putts himselfe upon the Country and Levin Gale who for his said Lordship in this Bahalfe Prosecutes Likewise Whereupon the afd William Roberts afterwards in the Same Court in his proper person Relinquisheth his verification afd and Says that of the Premisses afd as by the Information above him him Imposed he is guilty thereof and is willing to make fine to his Lordship the Lord proprietary for the fact afd Wherefore it is Considered by the Justices here that the afd William Roberts be fined to his Lordship the Lord proprietary for the fact afd the Sum of One hundred pounds of tob.o and that he be taken &c, thereupon the Said William Roberts is dischared paying the fine afd and the Severall Officers their fees due by Occasion of the premisses afd &c
Being within y.e County afd & within ye Jur of this Court) By the Court of ye County afd on the Nineteenth day of November Anno Dom One thousand Seven hundred & twenty three then at Dividing Creek in y.e s.d County Judicially Sitting in the said County Judicially Sitting hath Neglected to Keep the Said Road in Repair and Clear it within the Said Precints according to the form of the act of assembly in Such Case made and provided against the form of the Said act of assembly and against the Peace &c whereof the Said Levin for the Said Lord proprietary prays advisement of the Court herein the premisses and that due process of Law may Issue &c L Gale P Dom P.ry Thereupon Command was given to the Sherr of Somersett County that he Should take the said Thomas Newbold if &c to answer &c and afterward Came the Said Thomas Newbold hereinto Court in his proper person ^and^ the Information being unto him read is thereupon Instantly (demanded) |
