162 demanded how he would acquitt himselfe of the premises afd says that of the premisses afd upon him Imposed says that of the premises afd upon him Imposed he is guilty thereof and that he is Inocent of the Premisses and because he will not Contend with the Lord proprietary he putts himselfe in mercy of the Court and is willing to make fine for the fact afd wherefore it is Considered by the Court that the said Thomas Newbold be fined to his Lordship the Lord Proprietary the Sum of One hundred pounds of tobo for the fact afd and that he be taken &c thereupon the said Thomas Newbold is discharged paying the fine afd and the Severall Officers their Fees due by Occasion of the premisses afd &c
Somersett County afd within the Jurisdiction of this Court was Indebted unto the afd Joseph in the Sum of five hundred and Sixty two pounds of tobacco as by acco.t herewithin Court produced may appear and so thereof being Indebted the Said Thomas in Consideration thereof afterward to witt the Same day and Year afd at the County afd within the Jurisdiction of this Court upon himselfe assumed and to the Said Joseph then and there faithfully promised that he when afterwards he Should be thereto requested he the Said Sum of five hundred and Sixty ^two^ pounds of tob.o to the Same Joseph would well and faithfully Content and pay Nevertheless the Said Thomas his promise and assumption afd in form afd made Little regarding and plotting and fraudulently Intending the Same Joseph in that part Craftilly and Subtilly to defraud and deceive he the Said Sum of five hundred and Sixty two pounds of tobacco or any part thereof to the Same Joseph altho' the afd Thomas afterwards to witt the Same day and Year afd Last mentioned and often afterwards at Somersett County afd within the Jurisdiction afd by the Same Joseph was requested hath not paid or him for it in anywise Contented but the said Thomas the same hitherto to do hath altogether refused and Still doth refuse whereby the Same Joseph says he is worse and hath damage to the value of three thousand pounds of tobo and thereof he bringeth this Suite &c L Gale P Quer Pledges &.c Jno Doe R Roe
