the Indictm.t afd mentioned to five hundred pounds of tobacco         Wherefore it is Considered by
the Justices here that the afd Thomas Davis pay unto the afd Daniel Maddox the party deprived four
fould of the value of the goods afd amounting in the whole to the Sum of two thousand pounds of
tobacco (the afd goods being valued to five hundred pounds of tobacco by the Court here according to Law)
And that the afd Thomas Davis be whipt with ten Lashes on the Bare Back well Laid on untill the
blood appear and that he Stand in the Pillowry a quarter of an hour and that he be taken &c
And thereupon as to the Corporall punishment afd Command is given to the Sherr of Somersett
County that he do thereof Immediate Execution according to the Judgm.t afd rendered by whiping the
afd Thomas Davis at the Publick whiping post with ten Lashes on the Bare Back well Laid on
untill the Blood appear and by sitting him in the pillowry a quarter of an hour afterwards in
the Same Court the Sherr Returns that he hath done the Execution of the Judgm.t afd as to the
Corporall punishment afd he was Commanded   Whereupon it is ordered by the Court that the
afd Thomas Davis Return home to his Master Waters service and that his Said Master Return
him to the County Court or Sherr of the County ^at the Expiration of his Servitude^ to be dealt with according to Law &c

province that now id for the body of Somersett County upon their Oath do present
that Thomas Davis Late of Somrsett County Bricklayer & Negro Jacob
Late of ye sd County Labourer the tenth day of July Anno Dom One thousand
Seven hundred & twenty Six With force & Arms &c  At Somrsett County afd within
ye Jur of this Court one Suit of Cloaths of ye value of five hundred pounds of tob.o
One Coat of ye value of one hundred & fifty pounds of Tob.o One Shirt of ye value of
forty One hundred pounds of Tob.o & two pair of stockins of ye value of forty pd.s
then & there feloniously did take Steal & Carry away ag.t ye Peace of ye Right Honrble
the Lord Proprietary his Good rule & Governm.t & also ag.t ye form of the Act of
Assembly in Such Case Made & Provided &a

                      Thereupon Command was given to the Sherr of Somersett County that he Should
take the afd Negro Jacob if &c to answer &c and afterwards in the Same Court Came the afd Negro Jacob
in Custody of the Sherr of Somersett County into whose Custody before that time was Committed for
the Caus afd and being by the Sherr sett to the Barr and the Indictm.t read is thereupon demanded
how he would acquitt himselfe upon the Country and Levin Gale who for his Said Lordship in this behalfe
prosecutes Likewise            thereupon Command is given to the Sherr of Somersett County that
Immediately he Caus to Come here twelve &c by whom &c who Neither &c to Recognize &c because
as well &c of which said Preceipt the Said Sherr to witt Francis Allen Gent; Now hereat this day to
with the same day and year makes Return that he hath here Ready twelve &c as by his said
Preceipt he was Commanded and the Jurors of that Jury therein Impannelled being Called Came
