at Somersett County afd within the Jurisdiction of this Court One Suite of Cloaths of the value of five hundred pounds of tobacco One Coat of the value of one hundred and fifty pounds of tobacco one Shirt of the value of one hundred pounds of tobo and two pair of Stockens of the value of forty pounds of tob.o of the goods and Chattells of a Certain Daniel Maddox then and there being found then and there feloniously did ^take^ Steal and Carry away against the Peace of of the Right honrble the Lord propry his good Rule and Government and also against the form of the act of assembly in Such Case made and provided &c L Gale P Dom prop Test W.m Planner, John Kellem, Jn.o White Junr On the Backside of the foregoing Bill of Indictment it was thus Endorsed viz.t Billa vera Ja: MccMorie Foreman Thereupon Command was given to the Sherr of Somersett County that he Should take the Said Thomas Davis if &c to answer &c and afterwards in the Same Court Came the Said Thomas Davis in Custody of the Sherr and being by the Said Sherr Put to the Barr is thereupon Instantly demanded how he would would acquitt himselfe of the felony afd says that of the felony afd so as afd upon him Imposed my that he is now noe ways guilty thereof and for tryall thereof putts himselfe upon the County and Levin Gale his Lordships attorney who for his Said Lordship in this Behalfe prosecutes Likewise &c Thereupon Command was given to the Sherr: of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to Recognize &c because as well &c of which Preceipt the Said Sherr to witt Francis Allen Gent Now hereat this day to witt makes return that he hath here ready twelve &c as by his Said preceipt he was Commanded and the Jurors of that Jury therein Impannelled Being Called Came to witt William Handy, Thomas Layfeild, William Sasser Benj.a Fooks, Thomas Pullett, Jn.o Fleming, Thomas Bevins, Jn.o Dennis Sen.r Cannon Winwright James Mumford, Isaac Brittingham and Robert Mills who being duely Elected tryed and sworn to say the truth in the premisses afd upon their Oath do Say that the afd Thomas Davis is guilty of the Felony whereof he Stands Indicted &c whereupon ye Court here valued the goods in (the) |
