Kirkminster and Freinds Denyall the Boundarys whereof are decayed and the Wittnesses to prove them antient and Inform your Petition therefore prays that your worships will Issue a Commission to Such Persons as you Shall think proper according to the form of the act of assembly in Such Case Lately made to Examine Wittnesses in order to perpetuate the said Boundary's and your Petitioner as in duty bound Shall Ever pray John Caldwell The Petition afd being Read and heard and the Premisses Considered It's thereupon Ordered by the Court that a Commission of Issue as by ^the^ a petition afd is prayed and that Joseph Venables John Roach, Ebenezer Handy and Thomas Humphry's of Somersett County Gent be Commissioners and Execute the same Commission according to Law in Such Case made and provided &c Whereupon it is Ordered by the Court that the Sherr of Somersett County Return a Sufficient Number of good and Lawfull men of his Bailywick to Compleat and make up a grand Jury for the Body of Somersett County &.c Thereupon the Said Sherr being Called makes return of the Pannel of the grand Jurors Returns the Same which Jurors are as followeth viz.t James M.ccMorie Isaiah Bredall, Martin Kennett, Benjamin Tull, Jonathan Cottingham, Edmond Crapper, John Townsend Jun.r Alexander Lackey, Lewis Disharoon, Abraham Smith, Richard Knight, Giddion Tilman, Thomas Gray, Robert Mitchell, Robert Harris, John Broughton and Daniel Cawdery who being severally Called appeared and were Charged and Sent Out to Consider who Soon after return and present to the Court here one Bill of of Indictm.t viz.t against Thomas Davis and Negro Jacob being Content that the Court Should amend form altering no manner of Substance in the Said Bill which they found to be true thereupon the grand Jurors are discharged and ordered that they be allowed for their publick Service this Court the Sum of one hundred pounds of tob.o to be paid next Levy Court &c
Security as the Law in Such Cases Directs &c Now here at this day to witt the Sixteenth day of August ann.o Dom One thousand Seven hundred and twenty Six Came hereinto Court the afd Alexander Lackey in his proper person together with John Caldwell and John Evans Sen.r both of Somersett County Gent his Securitys and did then and there acknowledge themselves to Owe and Stand Justly Indebted unto the afd Mathew Nutter the Younger in the Sum of one hundred pounds Sterr Joyntly and Severally upon their bodys goods or Chattels Lands or tenements to be Levied for the Use of the Said Mathew Nutter the Younger his heirs of assignes In Case the Said Alexander Lackey Do not in Every Respect Comply with the Law's |
