158 Maryland fs Dorchester County fs Then Came before me the subscriber one of his Lpps Justices of the provinciall Court the above Named Thomas Nevett & made oath on y.e holy Evangelest of almighty god that the above acc.o is Just and true and that he never rec.d any part or percell thereof aprill 13.th 1726 S.t Leger Codd Whereupon the said James English in his proper person Comes and Defends the Force and Injury when &.c and Says that he Cannot gainsay the Plft his action afd so as aforesaid against him brought nor Can he Say but that the said plft Ought to recover his damages by Occasion of the Nonperformance of the promise and assumption afd to five hundred and Sixty three pounds of tob.o and Costs of Suite against him which y.e Said Plft doth not gainsay &c Therefore it is Considered by the Justices here the Twenty first day of June ann.o Dom One thousand seven hundred and twenty Six that the afd Thomas Nevett recover against the afd James English as well the Sum of Five hundred & thirty six^ty three^ pounds of tobo his 316 damages afd in form afd Confessed as also the Sum of three hundred and forty pounds of tobacco for his Costs and Charges by him about his Suite in that part Expended to the same Thomas Nevett by the Court here adjudged with Stay of Execution till the tenth day of November Next and the afd deft in mercy &c The Court adjourns till the third tuesday of august anno Dom 1726 |
