against the afd Thomas Brown as well the Sum of Nine hundred and Seventy Eight
pounds of tob.o his damages afd in form afd Confesed as also the Sum of Two hundred
256   and fifty Six            pounds of tobacco for his Costs and Charges by him about his
Suite in that Part Expended ^to^ the Same Joseph by the Court here of his assent adjudged &
the afd Deft in Mercy &c

was attached to answer unto Thomas Nevett of a plea of trespass
upon the Case &c


                      And whereupon the Same Thomas Nevett by Levin Gale his attorney
       Complains that whereas the afd James the fourth day of December ann.o Dom one thousand
       Seven hundred and twenty four at Somersett County afd within the Jurisdiction of
       this Court was Indebted unto the Same Thomas in the Sum of five hundred and sixty
       three pounds of tobo as by acco.t herewith in Court Produced may appear and so thereof
       being Indebted the Said James in Consideration thereof afterwards to witt the day and year afd
       at the County afd within y.e afd Jurisdiction upon himselfe assumed and to the same Thomas
       then and there did faithfully promise that he when afterwards he should be thereto
       requested the afd sum of five hundred and sixty three pounds of tob.o to the said Tho.s
       he would well & faithfully Content and pay nevertheless the said James his promise
       and assumption afd in form made Little regarding but plotting & fraudulently
       Intending the afd Thomas in that part to defraud and deceive he the afd sum of five
       hundred and sixty three pounds of tob.o or any part thereof to ye same Thomas (altho'
       afterwards to witt the same day and year afd at the County afd within y.e afd Jur
       he was thereto requested) hath not paid or him for it in anywise Contented but ye s.d
       James the same hitherto to doe hath altogether refused & still doth refuse to the
       Damage of y.e same Thomas Eleven hundred and twenty Six pounds of tobacco and
