15 premisses against the afd Tobias Burke ought to recover but because it is not Known what damages the afd Thomas Holbrook and Sarah his wife hat have sustained by occasion of the premises afd Wherefore the Justices at the prayer of the afd Thomas Holbrook and Sarah his wife by their attorney afd according to act of assembly in Such Case made and provided ^by the assent of the said deft by his attorney afd doe^ assess the damages of the afd Thomas and Sarah by occasion of the premisses afd besides their Costs and Charges to twelve hundred pounds of tobacco Therefore it is Considered by the Justices here the sixteenth day of march ann Dom One thousand seven hundred & twenty four afd that the afd Thomas Holbrook and Sarah his wife recover against the afd Tobias Burke as well the sum of twelve hundred pounds of tobo their damages by occasion of the premisses afd in form afd by the Justices assessed as also the sume of (313) three hundred and thirteen pounds of tobacco by the Court here adjudged unto them for their Costs and Charges by them about their suite in this behalfe Laid Out & Expended and the afd Tobias Burke in Mercy &c Thereupon at the prayer of the afd Tobias Burke by his attorney afd It's Ordered by the Court that his Lordships Writt of Enquiry of Damages Issue in the plea afd between ye Partyes afd Returnable to the Next Court ^to be^ helden for the County afd the third tuesday of June next & the same day is given to the afd Thomas Holbrook Etuxor also &c |
