14 the Court afd before the Justices afd to Enquire for the said Right honrble the Lord proprietary then & there Impannelled and Charged and Sworne falsely and Maliciously did Exhibitt and the afd Tobias altho' he well Know all and singular the premisses in the said Bill of Indictmt Contained to be falce feigned and Contrary to truth then and thereupon his oath falsely Maliciously wickedly and scandelously to the grand Jurors afd did asscert and assoin the matter in the said Bill so as afd Contained to be true whereas in truth the Matter afd against her the said Sarah in the Bill afd Contained above specified was falce and Contrary to truth and by the afd Tobias falsely wickedly and Maliciously devised with intent to molest defame & perplex the said Sarah and after that the afd Tobias had given Evidence as afd upon the bill of Indictm.t afd to the afd ^afd^ Grand Jurors they the afd Grand Jurors then and there to witt at ye Court afd at dividing Creek afd in the County afd to the Justices afd gave their answer that they of the Matter in the said bill so as afd Contained were altogether Ignorant by pretext of which prosecution the said Sarah not only in her good Name fame Creditt State and reputation which before was untoucht is Greivously hurt but also the said Thomas and Sarah divers Sums of money and tobacco in and about the purgation of the Said Sarah in the premisses afd to Expend and Lay out were and are forced and Compelled and in doing Divers their Lawfull Callings and honest affairs are much hindred and Made worse to their damage of ten thousand pounds of tobacco and thereupon they bring this Suite &c F Allen P Querbus Pledges def Jno Doe R Roe And the said Tobias Burke by George Dashiell his attorney Cometh and defendeth the force and Injury when &c and prayeth Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the afd Thomas Holbrook and Sarah his wife also Att which said next Court to witt the seventeenth day of November anno Dom one thousand seven hundred and twenty four Came againe as well the afd Thomas Holbrook and Sarah his wife as the afd Tobias Burke by their attorneys afd and thereupon the said Tobias Burke by his said attorney prayed further Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the afd Thomas Holbrook and Sarah his Wife also Att which said next Court to witt the sixteenth day of March anno Dom One thousand seven hundred and twenty four Came againe as well the afd Thomas Holbrook and Sarah his wife as the afd Tobias Burke by their attorneys afd and the same attorney of the same Tobias saith that he is not Informed by the same Tobias his Clyant of any answer for the same Tobias to the afd Thomas Holbrook and Sarah his wife in the plea afd to be given and Nothing Else thereof say's by that the same Thomas and Sarah Remain's against the afd Tobias thereof Undefended &c Wherefore the said Thomas Holbrook and Sarah his wife their damages by occasion of the (premisses) |
