thereof Says by which the Same Plft Remains against the afd Deft thereof undefended

             Whereupon the afd Benjamin Wailes by his attorney afd prays the Court that they
may according to act of assembly in Such Case made and provided dissolve themselves into a Court
of Chancery and hear and determine the action afd in the plea afd according to the meritts thereof &c
which is granted &c    Whereupon all and Singular the premisses by the Court being heard and fully understood
and mature deliberation thereupon had

                   Whereupon it is decreed by the Court that the afd Benjamin Wailes Recover
against the afd W.m McClammey adm.r as afd the Sum of four hundred and five pounds of tobo
to be Levied of the goods and Chattells which were of the afd Woney MccClammey at the time of his death
in the hands of the Same W.m Macclamey to be administred if so much thereof he hath &c and further
it is decreed by the Court that Each Party that is Plft and deft pay their Own Costs vizt

                        Isaac Brittingham Late of Somersett County planter
was attached to answer unto Benjamin Wailes of a plea of trespass upon
the Case &c
                                                                        And whereupon the Same Benjamin by Levin Gale his
       attorney Complaines that whereas the afd Isaac the tenth day of June Seventeen hundred and
       twenty two at Somersett County afd within the Jurisdiction of this Court was Indebted unto the
       Same Benjamin in the Sum of three thousand Seven hundred and thirty three pounds of tob.o
       as by and herewith in Court produced may appear for Sherr & Officers Fees and so thereof being Indebted
       the Said Isaac in Consideration thereof Afterwards to witt the Same day & year afd att the
       County afd within the afd Jurisdiction upon himselfe assumed & to the Same Benjamin then
       and there faithfully promised that he when afterwards he Should be thereto requested he the said
       Sum of three thousand Seven hundred & thirty three pounds of tob.o to the Same Benjamin wou'd
       well & faithfully Content and pay and also the afd Isaac Brittingham afterwards that is to say the
       afd tenth day of June in the year afd at y.e County afd within the Jurisdiction afd was Indebted
       unto the Same Benjamin in an Other three thousand Seven hundred & thirty three pounds
       of tobacco for the Like Sum of Divers persons before that time for the use of the said Benjamin
       by the Said Isaac had and rec.d & so thereof Being Indebted ye s.d Isaac in Consideration thereof
       afterwards that is to say the Same day and year Last mentioned at the County afd within the
       Jurisdiction afd upon himselfe assumed and to the Same Benjamin then & there faithfully
       promised that he when afterwards he Should be thereunto requested the afd Sum of three
