Benjamin in the Sum of Six hundred and twenty one pounds of tobacco as by account herewithin Court
produced may appear and so thereof being Indebted the Said Woney in his Lifetime afterwards to witt
the Same day and year afd at the County afd within the afd Jurisdiction in Consideration thereof upon himselfe
assumed and to the Said Benjamin then and there faithfully promised that he when afterwards he
should be thereunto Required he the afd Sum of Six hundred and One pounds of tob.o to the same Benjamin
Wailes would well and faithfully Content and pay Nevertheless the Said Woney in his Life time and
the afd William since the Death of the said Woney the promis and assumption afd of the said Woney in his LIfetime
so as afd made Little Regarding and plotting and fraudulently Intending the Same Benjamin
Wailes in this part to Defraud and Deceive Nither the afd Woney in his Lifetime nor the afd William since
the Death of the afd Woney the afd Sum of six hundred and twenty one pounds of Tob.o hath or any part thereof
to the Same Benjamin hath paid or him for it in any wise Contented altho' the said Woney in his Life time
afterwards to witt the Day and year afd and the afd William since the Death of the said Woney to witt y.e tenth
day of June Seven hundred & twenty three at the County afd within y.e afd Jurisdiction was thereunto required
but they the Same hitherto to pay or anyway to Content hath altogether refused and the afd William the
same to doe Still doth refuse whereby the same Benjamin says he is worse and hath Damage to y.e value
of two thousand pds of tobo & thereof he Brings this Suite &.c     L Gale P Quer pledges &.c Jn.o Doe   Rich.d Roe

And the afd William Maclemey administrator of the said Woney Maclemey by George Dashiell
his attorney Cometh and defendeth the force and Injury when &.c and prays Leave to Imparle hereunto
untill the next Court and he hath it and the Same day is given to the afd Plft also

Att which said next Court to witt the twenty first day of June ann.o Dom one thousand seven hundred
and twenty six Came againe as well the afd Plft as the afd Deft by their attorneys afd and thereupon
the afd attorney says that of the same deft says that he is not Informed by the afd Deft his Clyant
of any answer for the Same deft to the Same plft in the plea afd to be given and nothing Else
