148 thousand Seven Hundred and thirty three pounds of tob.o Last mentoined to the same Benjamin wou'd well and faithfully Content and pay Nevertheless the Said Isaac his Severall Promises & assumptions afd in form afd made not Regarding but Plotting and fraudulently Intending the Same Benjamin in that part to defraud and Deceive the afd Severall Sums of tob.o or any part thereof to the Same Benjamin Wailes hath not paid or him for itt in anywise Contented altho the Same to doe the Said Isaac afterwards that is to say the tenth day of June Seventeen hundred and twenty five at the County afd within the afd Jurisdiction by the Same Benjamin was Requested but the Said Isaac the same hitherto to the said Benjamin to pay or him for it in any wise to Content hath altogether & still doth Refuse to the damage of the Same Benjamin Seven hundred pounds of tob.o & thereof he brings this suite &.c L Gale P Querr pledges &.c Jn.o Doe Rich.d Roe
Proved in Open Court by Benjamin Wailes Test Thomas Hayward Cl And the said Isaac Brittingham by George Dashiell his attorney Cometh and defendeth the force and Injury when &.c and prays Leave to Imparle hereunto untill the next Court and he have it and the same day is given to teh afd Plft also Att which said next Court to witt the twenty first day of June ann Dom one thousand seven hundred and twenty six Cometh again as well the afd Plft as the afd Deft by their attorneys afd and the afd deft by his said attorney as before defends the force and Injury when &.c and saith that he did not assume upon himselfe in manner and form as the Plft above against him hath |
