          June Court       1726                147

Layfeild at the prayer of the plfts attorney afd is adjudged to give Speciall bail to the
action afd but for want thereof the said Thomas Layfeild is Committed into the Custody
of the Sherr of Somersett County thereto remain the Said Sherr being Present took Charge
of the Said Thomas Layfeild accordingly thereupon day is given to the Said Thomas Layfeild
in Custody as afd untill next Court and the Same day is given to the Plft also

Att which Said Next Court to witt the twenty first day of June Ann Dom One thousand
Seven hundred and twenty Six Came again as well the Said Joseph MccClester by his attorney afd
as the Said Thomas Layfield in Custody as afd and thereupon the Francis Allen of Somersett
County Gentleman present here in Court undertakes for the Said Thomas Layfeild that in Case
the Said Joseph MccClester Shall Recover Judgm.t in the plea afd against the Said Thomas
Layfeild or that the Said Thomas Layfeild Shall be therein Convict that then he the Said Tho.s
Layfeild Shall pay the Condemnation of the Court thereupon or Render his Body to the Custody
of the Sherr of Somersett County in Satisfaction thereof or that he the said Francis Allen
will do it for him thereupon the said Thomas Layfeild is Discharged from Out of Custody
afd
                    Whereupon the afd Joseph MccClester by his attorney afd prays that the afd
Thomas Layfeild to his declaration in the plea afd may answer but the Said Thomas
Layfeild altho' Solemnly Called Came not but made default wherby the afd Plft remains
against the afd Deft wholly undefended &c

                   Therefore it is Considered by the Justices here the same day and Year Last
mentioned that the afd Joseph MccClester Recover against the afd Thomas Layfeild as well
the Sum of three thousand Six hundred and Eighty One pounds of tobo his Damages by
436   Occasion of ^the^ premises afd as also the Sum of four hundred and thirty Six
pounds of tob.o by the Court here adjudged unto him for his Costs and Charges by him about his Suite
in this behalfe Laid Out and Expended and the afd Deft in mercy &c

                   And whereupon the Same Benjamin by Levin Gale his attorney Complains that whereas
       the afd Woney Maclemey in his Lifetime the tenth day of May One thousand Seven hundred and twenty
       One at Somersett County afd within the Jurisdiction of this Court was Indebted unto the Same
