 Somersett fs:
                   Thomas Layfeild Late of Somersett County Gent was attached to answer unto
Joseph MaClester of a plea of trespass upon the Case &c
And whereupon the Said Joseph by Levin Gale his attorney Complaines that whereas the Said Thomas the thirtieth
day of November anno Dom one thousand Seven hundred and twenty four at Somersett County afd within the
Jur of this Court was Indebted unto the said Joseph in three thousand six hundred & Eighty one pounds of tob.o
for Levies Sherr Fees and Publick Dues to the said Jos: then and there due owing and unpaid as by an acco.t thereof
hereunto annexed may in Court appear and being so thereof Indebted the said Thomas in Consideration thereof afterwards
to witt the Same day and year afd at the place afd upon himselfe did assume and to the said Joseph then
and there did faithfully promise that he the Said Thomas the afd three thousand Six hundred & Eighty one pounds
of tob.o to the Said Joseph when he Should be afterwards thereunto requested he would well and faithfully pay
and Content Nevertheless the Said Joseph his promise and assumption afd in form afd made Little Regarding
but Plotting and fraudulently Intending the Said Joseph in that part Craftily and Subtilly to deceive and
Defraud the afd three thousand Six hundred and Eighty one pounds of tob.o to the Said Joseph he hath not paid
or ^to^ him for the Same in anywise Contented altho' the Same to doe the Said Tho.s by y.e Said Joseph on the first
Day of august ann Dom one thousand Seven hundred and twenty Five and often afterwards at the County afd
within the Jurisdiction afd he was thereunto requested but the Same to him the to pay or in any wise to
Content hath refused and Still doth Refuse and Deny Whereupon the said Joseph Saith he is worse
and hath Damage to y.e value of Seven thousand three hundred and Sixty two pounds of tob.o and thereupon
