Kirke further inform'd him that the afd Bounder was a Red oake & then Rotten Butt he
told this Deponient that he had putt a stone and a bone in the hole of y.e Stump of the tree afd
and further this Deponient Saith Nott      Taken before us this 20.th day of June 1726

Robert Scott af'd forty Seven years or thereabouts Deposeth on the Holy Evangelist
of almighty god   that about thirty years since he this Deponient was assisting his farther
William Scott to make a Bridge and Timber being Scarce of his farthers towards John
Kirks pretentions and Soeing a mark't pine told us meaning my Selfe & Brothers that that
pine was nott John Kirk's Bounder butt Such An oake Stump was which Stood as near
as this Deponient Can Remember within thirty yards of the End of y.e afd Cow bridge and
further this Deponient Saith Nott      Taken Before us this 26.th day of June 1726

Command was given to the Sherr of Somersett County that he
Should take Comfort Ayres Late of Somersett County admrx of the goods
and Chattells &c of Henry Aires Late of Somersett County dec.d if She should
                      be found in his Bailywick and her Should Safe Keep so that he might have her
       body before the Justices of his Lordships County Court of Somersett ^to be held at Dividing Creek^ the third tuesday of august
       then next to answer unto William Pepper of a plea of trespass upon the Case &c and that thereof
       he Should not fail &c
                                                 Att which said third tuesday of August to witt the Seventeenth day
       of the Same Month Ann Dom One thousand Seven hundred and twenty five being the day
       of the Return of the Same writt Cometh the said William Pepper by his attorney afd and the
       Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh
       Return thereof to the Court here Endorsed in these words viz.t Cepi Corpus   Jos: MccClester sher

                And the said Comfort Ayres by George Dashiell her attorney Came and defended the
       force and Injury when &c and prayeth Leave to Imparle hereunto untill the Next Court
       and she hath it and the Same day is given to the afd Plft also

             Att which said next Court to witt the Sixteenth day of Novem Ann Dom one thousand Seven hundred
       and twenty five Came again as well the afd Plft as the afd Deft by their attorneys afd and thereupon     
       the afd Deft by her said attorney prayed further Leave to Imparle hereunto untill the
