144 might not find it by that marke because he had ordred John Gunbee to goe and take away the Broken part of the tree Leaft the fire might gitt therein and Destroy the whole Tree Then this Deponent as he y.e afd Jn.o Kirke if itt was mere a Chesnutt where the Indians Had got Boles Sometime before then he reply'd that itt was just by that place and if he would goe there he would Certainly find itt upon which this Deponent did goe and with Jn.o Gunbee's assistance did find Such a tree Scituate as afore discribed by Jn.o Kirk which this Deponent shows as the ^abovesaid^ Tree this twentieth Day of June Anno Dom 1726 and further Saith Nott Anthony Bell Taken ^before us^ Before us this 20th Day June 1726 Robert King, Ephraim Wilson, Thomas Williams, Jeffy Long John Gunby aged forty Eight years or their abouts Deposeth on the holy Evangelest of almighty God that John Kirk went to a Stooping white oake in Cumpany with this Deponient about thirty years agoe which oake is the same tree that anthony Bell has this Day showed to be the Tree discrb'd to him by Jn.o Kirke some few Days before ye sd Kirks Decease and that the afd Kirke told this Deponient that y.e white oake abovementioned was y.e Last Bounder of Middle Ridge and the first Bounder of Golloway & further this Deponient Saith Not taken this 20.th Day of June 1726 Jn.o Gunby John Gunby ag'd forty Eight years or thereabouts Deposeth on the holy Evengelist of almighty god That Jn.o Kirk about Thirty years agoe on a hamock of Woods Called Bayside hamock the Westermost part of ye sd Hamock ye afd Kirke showed this Deponient (that an oake did standeth) what sort of an oake this Deponient Knoweth not which was the first Bounder of a percell of Land Called Recovery belonging to the afd Kirke & further this Deponient Saith not taken this 20.th day of June 1726 John Gunby further Deposeth that John Kirke above thirty agoe went with this Deponient to the End of a hamock adjacent to a Bridge Called W.m Scott Cow Bridge within fifty yards of the pitch of ye point & there Show'd him this Deponient a hole were their was an old stump of an oake which the afd John Kirk Showd him this Deponient for his Last Bounders of that tract of Land Called Recovery and further saith not Taken before us ye 20.th day of June 1726 Rob.t King, Eph.m Willson, Tho.s Williams, Jeffry Long John Gunby John Kellem aged forty five years or there abouts Deposeth on the Holy Evengelist of almighty God That John Kirke told him this Deponient on Bay side Hamock the westermost side part of the said Hamcok) stood the first Bounder of a tract of Land Belonging to the afd Kirke Called Recovery & further this Deponient saith nott Taken this 20.th day of June 1726 John Kellem John Kellem abovesaid further Deposeth that John Kirke about twenty years since or thereabouts told him this Deponient that the Last Bounder of a tract of Land of his Called Recovery Stood on a point of Land Near W.m Scotts Cow Bridge and that he the afd John (Kirke) |
