144 Somersett County fs Charles absolute Lord and proprietary of the provinces of maryland and avalon Lord Baron of Baltemore &c To Robert King Ephraim Willson, Tho.s Williams, and Jeffrey Long all of Somersett County Gent Greeting Know ye that we have appointed you or any three or two of you to be our Commissioners to Examine Evidences on behalfe of a Certain Will.m Planner next friend to Sarah Kirke a minor of the County afd Gent in Relation to the Bounds of two tracts of Land Lying in the County afd the one Called Golloway the other Recovery we therefore Require you or any three or two of you att Some time and place as to you or any three or two of you Shall Seem Convenient you meet on ye afd Lands Called Golloway and Recovery (you first having Taken your oath on the Holy Evangelist of almighty god according to act of assembly in Such Case made and provided) & then Cause to Come before you or any three or two of you all Such Evidences as Shall be to you or any three or two of you nominated by the said Complement (or Deft if any) & y.t you Examine them upon their Corporall oaths to be by you or any three or two of you administred on the Holy Evangelist of almighty god in the presents of y.e Complainent (or Deft if any) touching the truth or Remembrance of their Knowledge or any thing that may Relate to the Cause afd & yt Reducing the Severall Depositions into Writting you Send the Same together with this our Commission under your or any three or two of your hands to our County Court of Somersett with all Convenient Speed Wittness Samuel Hopkins Gent Chief Justice of our said Court the twenty third day of aprill in the Eleventh year of our Dominion &c Ann Dom one thousand Seven hundred and twenty Six (p order) Thomas Hayward Cl on the Backside of the foregoing Commission itt was thus Endorsed viz.t By Vertue of the within Commission to us Directted being Duly Quallifyed & having given the Notice Required by Act of assembly doe herewith Return ye Severall deposition hereunto annext as Wittness our hands this twentieth day of June Seventeen hundred & twenty Six Rob.t King Anthony Bell aged Sixty Nine years on thereabouts Deposeth on the Eph.m Wilson holy Evangelist of Almighty god that about two or three days before ^Jno Kirke^ he dy'd Tho.s Williams he ye sd Kirk sent for this Deponent & told him he had Sent for him to Goe and Jeffry Long Shoe his wife Bridgett the first Bounder of a tract of Land Called Golloways least John Gunbee (or his wife Brigett afd) Should trespass on Each Other not Knowing were the tree stood & that he the s.d Kirke Should Never be able again to goe and Show the afd Bounder to any Body himselfe This Deponient Replyed he did not Know how he Should find itt y.e afd Kirke told him that the tree was a Stooping white oake & Stood near to the deep Slash where it went into the great Swamp and for a further mark that this Deponient might find the tree afd he acquainted him that the top of the tree was Broke of & pitcht into the Ground and Lean'd against the Same tree upon which the afd John Kirke Recollected his ^Memory^ Mony and Said that he this Deponient (might) |
