the Condemnation of the Court thereupon or Render his body to the Custody of the sherr of Somersett County

 Memorand.m the Plft by Levin Gale his attorney Sued Out his Lordships writt
of attachm.t ag.t the Deft the tenor whereof follo^w^eth in these words viz.t
    Somersett fs  Charles absolute Lord and proprietary of the provinces of
of Maryland and Avalon Lord Baron of Baltemore &c     To the Sherr of Somersett
    County Greeting we Command you that you attach any the goods Chattells Rights or Creditts of Henry
    Fricks Late of Somersett County Planter if they Shall be found in your Bailywick to the Value of Nine
    Pounds One Shilling Curr.t mony and two hundred twenty Eight pounds of tobacco and when you have
    the Same attached or any part thereof the Same in your Custody safe Keep so that you have the Same
    before the Justices of Our County Court to be held at Dividing Creek the third tuesday of August next
    then and there to be Condemned according to act of assembly to and for the use of a Certain Joseph Venables
    unless the Said Henry Fricks by himselfe or attorney Shall appear and answer unto the Said Jos:
    Venables in a plea of trespass upon the Case &c according to Law and that by good and Lawfull men
    of your Bailywick you make Known unto the person or persons in whos hands you make the
    same attachment that he She or they be and appear before the Justices of Our Said County Court to be
    held as afd to Shew Cause if any he She or they have why the Same goods or Chattells Rights or Creditts
    so attached in his her or their hands ought not to be Condemned and Execution thereof had and made
    according to the form of the act of assembly in Such Case made and provided if to him her or them it
    Shall Seem mete and how you Shall Execute this writt that you make Known unto Our Said Justices
    at the Same day and place afd and have you then & there this Writt Wittness &c

       Att which Said third tuesday of august to witt the seventeenth day of the same month anno Dom one
    thousand Seven hundred and twenty five being the day of the Return of the Said Writt Cometh said
    Joseph Venables by his attorney afd and the Sherr of Somersett County to whom the foregoeing Writt was
    directed Likewise Cometh and maketh Return thereof to the Court here Endorsed viz.t

             By Vertue of the within Writt to me directed to the vorshipfull Justices within Mentioned
    I humbly Certifie that I have attached as the goods and Chattells rights or Creditts of the Within Named
    Henry Fricks in the hands of Isaac Noble Nine pounds and one Shilling Currt money and two
    hundred and Twenty Eight pounds of tobo and I further Certifie that I have given Notice to
    the said Isaac Noble that he be and appear at the time and place within Contained before to
    Shew Caus &c before Hugh Porter and Jno Doe good and Lawfull men of your my Bailywick

             And the Said Isaac Noble Garnishee as afd by George Dashiel his attorney Cometh and
    Defendeth the force and Injury when &c and prayeth Leave to Imparle hereunto untill the
