142 One thousand Seven hundred and Twenty Six being the day of the Return of the Said Writt Cometh the Said Joseph MccClester by his attorney afd and the Sherr of Somersett to whom the foregoeing writt was directed Likewise Cometh and Maketh Return thereof Endorsed in these words following viz.t By Vertue of the within Writt to me directed to the Within Named Justices I Certifie that on the thirty first day of August may One thousand seven hundred and ^twenty^ six I have attached Our four Year old ^black^ Stear and One DItto Brown Stear Each of the Value of two hundred and sixty four pounds of tobacco one Small pyde Stear of the value of two hundred pounds of tobo one Small four Year Old heifer and Calfe of the value of two hundred & Eighty pounds of tobo and One Crawscutt Saw Iron Splate of the value of the value of One hundred and twenty pounds of tobo which said goods were appraised by John Caldwell James Caldwell John Willson and Thomas Graverner good and Lawfull men of my Bailywick upon their Oath and were by me delivered to the Within Named Joseph MccClester whom I have Sumoned as Garnishee &c as by the within Writt I am Commanded so answers Fran: Allen Sher Whereupon the afd Joseph MccClester by his attorney afd prays that the goods and Chattells afd attached as of the Rights and Creditts of the Said Dicklow Beak may be Condemned in the hands of the Said Joseph MccClester toward satisfying unto him as well the Sum of twelve hundred pounds of tobo as also the Costs accrewing upon the writt of attachm.t afd Therefore it is Considered by the Justices here the twenty first day of June ann Dom one one thousand Seven hundred and twenty Six afd that the afd Cattle and Saw so as afd attached all of the value of Eleven hundred and twenty Eight pounds of tobo be Condemned in the hands of the said Joseph MccClester as of the Rights and Creditts of the Said Dicklow Beake towards Satisfying unto the Said Jos: MccClester as well the Sum of twelve hundred pounds of tobo as also the Costs accrewing upon the writt of attachm.t afd &c
Whereupon the Said John Bishop being Called appears and thereupon the said John Bishop at the prayer of the afd Ebenezer Cook is adjudged by the Court to give Speciall Bail to the action afd thereupon a Certain W.m Whittington present here in Court undertakes for the Said Jno Bishop that in Case the said Ebenezer Cook Shall Recover Judgm.t in the plea afd or that th against the Said John Bishop or that the Said John Bishop Shall be therein Convict that then he the Said John Bishop Shall pay (the) |
