140 Laying of the attachment afd in his hands vizt the tenth Day of June Anno Dom one thousand Seven hundred and twenty six at the County afd within the Jur of this Court had in his hands of the Efects of the said John Robinson and George Thompson to the Value of twenty pounds Sterling and Eight hundred pounds of tobo and this he prays may be Enquired of by the Cnntary Levin Gale for the Plft and the afd Andrew Likewise J Pemberton for the Deft Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who Neither &c to recognize &c because as well &c of which said preceipt the said Sherr to witt Francis Allen Gent Now here at this day to witt the twenty first day of June Anno Dom one thousand seven hundred and twenty Six makes Return that he hath here Ready twelve &c as by his said Preceipt he was Commanded and Now hereafterwards to witt the Same Day and year Came as well the afd Plft as the afd Deft by their attorneys afd and the Jurors of that Jury Impannelled Being Called Likewise Came to witt William Lane Thomas Pullett Jacob Messick Lewis Disharoon Samuel Tayler Sam.l Tommelinson, Jos: Langford Adam Spence Sen.r Thomas Purnall James Mumford Giddion Tilman Robert Hall who being duly Elected tryed and Sworn to Say the truth in the Premisses upon their Oath do Say that the Said Andrew Wailes Garnishee as afd had in his hands at the time of the Laying of the attachm.t afd of the Effects of the afd John Robinson and George Thompson to the value of twenty pounds Sterr and Eight hundred pounds of tobacco Whereupon the Said Capell King by his attorney afd prays that upon giving security according to act of assembly the Said Sum of twenty pounds Sterr and Eight hundred pounds of as of the Rights and Creditts of the afd John Robinson and George Thompson so as afd attached in the hands of the said Andrew Wailes towards Satisfaction of the Said Capell King his damages and Costs afd Thereupon Henry Ballard of Somersett County Gent present here in Court undertakes for the Said Capell King according to act of assembly that in Case the Said John Robinson and George Thompson do at anytime within a year and a day appear and make all or any part of the Said Capell King's Claim against him appear to be Satisfyed or Otherwise to have been undue before the Laying of this attachm.t that then the Said Capell King Shall make Restitution unto them the Said John Robinson and George Thompson of all or Such Part thereof as Shall be made appear to be undue &c or that he the Said Henry Ballard will do it for him &c Therefore it is Considered by the Justices here the twenty first day of June Anno Dom one thousand Seven hundred and twenty Six afd that the Said Sum of twenty pounds sterr and Eight hundred pounds of tob.o so as afd attached ^be Condemned^ in the hands of the afd Andrew Wailes Garnishee as afd as of the Rights and Creditts of the said Jno Robinson and George Thompson for the use of the Said Capell King towards sattisfying of his Damages and Costs as also it is Considered by the Justices that the Said Capell King Recover against the Said Andrew Wailes the Sum of Eight hundred and twenty One pounds of tobacco by the Court here adjudged unto him for his Costs and Charges in this behalfe Laid out and (Expended) |
