140 pounds Sterling mony and Eight Hundred pounds of tob.o & when you have the Same attached or any part thereof the Same in your Costody safe keep so that you have the same before the Justices of Our County Court to be held at Dividing Creek in Somrsett County afd the third tuesday of June Next then and there to be Condemned According to act of assembly to & for the use of a Certain Capell King unless the said John Robinson and George Thompson by them Selves or their attorneys Shall appear and answer unto the said Capell King in a plea of trespass upon the Case &c according to Law and that by good & Lawfull men of your Bailywick you make Known unto the person or persons in whose hands you make the Same attachment that he She or they be and appear before the Justices of our Said County Court to be held as afd to Shew Cause if any he she or they have why the Same goods or Chattells rights or Creditts so attached in his her or their hands ought not to be Condemned & Execution thereof had and made according to the form of the Act of assembly in Such Case made and provided if to him her or them it Should Seem mete and how you Shall Execute this Writt that you make Known unto our Said Justices at the Same Day and place afd and have you then and there this Writt Wittness Samuel Hopkins Gent Chiefe Justices of Our Said Court the twenty third day of Aprill in the Eleventh Year of Our Dominion &.c Ann Dom one thousand Seven hundred and twenty five Six (L Gale) Thomas Hayward Cl Cur Cour Som Att which said third tuesday of June to witt the twenty first day of the Same month ann.o Dom One thousand Seven hundred and twenty Six being the day of the return of the Said writt Cometh the Said Capell King by his attorney afd and the Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following vizt Attached full value in the hands of Andrew Wailes and Sumoned him as Garnishee before Jno Doe and Richard Roe good and Lawfull men of my Bailywick Fran Allen Sherr And the Said Andrew Wailes Garnishee as afd by Joseph Pemberton his attorney Cometh and defendeth the force and Injury when &.c and Saith that the afd Capell Condemnation of the Debt and Cost afd ag.t him the Said Andrew to have Ought not because he Saith that he the Said Andrew hath not any goods or Chattells or Mony of the Said John Robinson & George Thompson in his hands wherewith to Sattisfie the Same Nor had at the day of the Impetration of the Original Writt of the Said Capell Nor since had any &c and this he is ready to veryfie wherefore he prays Judgment if the Said Capell Condemnation as afd ag.t him to have ought &c J: P: P P & Deft And the afd Capell King by Levin Gale his attorney Saith that he by anything Prealedged from having Condemnation of the Premises afd in the hands of the afd Andrew so as afd attached ought Not to be Precluded because he Says that the Said Andrew at the time of the (Laying) |
