1726 139 our said Justices at the same and place afd and have you then and there this Writts Wittness &c Att which said third tuesday of June to witt the twenty first day of the same month Anno Dom one thousand seven hundred and twenty six being the day of the Return of the said Writt Cometh the afd John Dennis by his attorney afd and the Sherr of Somersett County to whom the foregoeing Writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed viz.t By vertue of the within Writt to me directed I have attached the full value of the within Mentioned Debt in the hands of Edward Rownd and have Sumoned him to appear before the Justices within Named at the day and place within Contained to Shew Cause &c as by the Within Writt I am Commanded before W.m Hopkins and John Doe good and Lawfull men of my Bailywick so answers Francis Allen Sherr Whereupon the afd Edward Rownd Garnishe of the afd Jonathan Woodbury appears in his own proper person and says he Cannot gainsay but that he has of the Rights and Creditts of the Said Jonathan Woodbury to the value of thirty six bushells of Indian Corn nor bu the Same ought to be Condemned in his hands for the use of the Said John Dennis as of the Rights and Creditts of the said Jonathan Woodbury which ye said Plft does not gainsay Whereupon the Said John Dennis his attorney afd prays that upon giving security according to act of assembly that the afd sum of thirty six bushells of Indian Corn so as afd Confessed by the afd Edward Rownds as of the Rights and Creditts of said Jonathan Woodbury may be Condemned in the hands of the said Edward Rownd towards satisfying unto the said John Dennis as well the Sum of Six hundred pounds of tob.o afd as also the Costs accrewing upon the writt of attachm.t afd thereupon a Certain Hugh Porter Present here in Court undertakes for the Said John Dennis according to act of assembly that in Case the Said Jonathan Woodbury do at any time within a year and a day appear and make all or any part of the Said John Dennis Claim against him appear to be Satisfyed or otherwise to have Been undue before the Laying of this attachm.t that then the Said John Dennis shall make Restitution unto him the Said Jonathan Woodbury of all or Such Part thereof as shall be made appear to be undue &c or that the Said Hugh Porter will do it for him Therefore it is Considered by the Justices here the twenty first day of June ann.o Dom One thousand seven hundred and twenty six that the afd sum of thirty six bushells of Indian Corn so as afd Confesed be Condemned in the hands of the said Edward Rownd as of the Rights and Creditts of the said Jonathan Woodbury towards satisfying unto the said John Dennis as well the Sum of Six hundred pounds of tobo as also the Costs accrewing upon the writt of attachm.t afd and that the said John Dennis have his Execution thereof against the afd Edward Rown according to act of assembly &c
