1726 138 Justices of Our Same Court at Dividing Creek and by Consideration of the Same Court obtained his Execution of a Certain Judgm.t against James Jones Sen.r of Stepney Parish in Somersett County Planter as well for the Sum of five hundred and ten pounds of tobacco Certain Damages together with the Sum of two hundred and ninety One pounds of tobo Costs of Suite as also the Sum of two hundred and forty pounds of tobacco by the Same Court here adjudged unto the Same Robert Martin for his Costs and Damages sustained by Occasion of Delay of Execution of the Judgm.t afd whereof he is Convict as by the Record and process thereof in Our Court before Our Justices at Dividing Creek now Remaining manifestly appeareth Nevertheless Execution of the Judgm.t afd as Yett Remaineth to be done; and the afd Robert Martin is Since dead as by the Insinuation of Mary Martin Relict and Executrix of the Last will and testament of the afd Robert Martin we have Received and because we are Willing that those things which in Our Said Court afd are Rightly done Should be duely Executed we Command you that by good and Lawfull men of your Bailywick you make Known unto the afd James Jones that he be and appear before Our Justices of Our County Court to be held at Dividing Creek in Somersett County afd the third tuesday of June next to Shew Cause if anything for himselfe he hath or Knoweth to Say wherefore the afd Mary Martin Execution of the Damages and Costs afd to have Ought not according to the form of the Recovery afd if to him it Shall Seem Mete Expedient and have you then and there the Names of those by whom you make the Same Known and this Writt Wittness Samuel Hopkins Gent Cheife Justice of Our Said Court the twenty third day of aprill in the Eleventh Year of Our Dominion &.c Ann Dom one thousand Seven hundred & twenty Six (L Gale) Thomas Hayward Cl Att which said third tuesday of June to witt the twenty first day of the Same month ann Dom One thousand Seven hundred and twenty F Six being the day of the Return of the Said Writt Cometh the Said Mary Martin by her attorney afd and the Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and Maketh Return thereof to the Court here Endorsed in these words viz.t Scire faci f Allen Sher whereupon the Said Mary Martin by her attorney Prays that the Said James Jones to her writt of Scire facias afd may answer but the Said James Jones altho' Solemnly Called Came not but made default nor Shews Caus why &c whereby the Same Plft Remains against the afd deft wholy undefended Therefore it is Considered by the Justices here the same day and year Last Mentioned that the afd Mary Martin Exrx as afd have her Execution against the afd James Jones for as well the Sum of Five hundred and ten pounds of tobo Certain Damages as also the sum of two hundred and Ninty ^one^ pounds of tobo Costs of Suite as also the Sum of two hundred and forty ^pds of tobo^ additionall Costs of Suite in the Judgm.t (afd) |
