133 Safe Keep so that he might have her body before the Justices of his Lordships County Court of Somersett the third tuesday of June then next to answer unto his Said Lordship Concerning a Certain presentm.t against her found ant that thereof he Should not fail &c Att which Said third tuesday of June being the twenty first day of the Same month anno Dom one thousand Seven hundred and twenty f six Came the Sherr of Somersett County to whom the foregoeing writt was directed and maketh Return thereof Endorsed in these words following vizt Cepi Corpus p Francis Allen Sherr Whereupon the Said Catherine Killy in her Own proper person appeareth and being sett to the bar is thereupon Instantly demanded how She would acquitt herselfe of the premisses afd above Imposed ^upon her^ says that of the premisses afd above upon her Imposed She is guilty thereof and makes Oath that a Certain Patrick Burn is the begetter of the Child She Stands presented for but hath not wherewithall to pay her fine for the fact afd Wherefore it is Considered by the Justices ^here^ that the afd Catherine Killy be had to the Publick whiping Post and there be whipt with twenty Lash on the bare back well Laid on and that She be taken &c and thereupon as to the Corporall punishm.t afd Command is given to the Sherr of Somersett County that he do thereof Immediate Execution according to the Judgm.t afd Rendered by whiping the afd Catherine Killy at the Publick Whiping Post with twenty Lashes on the bare back well Laid on untill the blood appear and afterwards in the Same Court the Sherr Returns that he has done the Execution of the Judgm.t afd as to the Corporall punish.t afd he was Commanded &c thereupon the Said Catherine Killy is ordered to give Security for fees due by occasion of the premisses afd whereupon a Certain Charles Cottingham of Somersett County present in Court undertakes for the said Catherine Killy to pay the Severall Officers their fees due by occasion of the premisses afd &c
said Elizabeth ackman of Stepney parish Spinster if She Shall be found in y his bailywick and her Should Safe Keep so that he might have her body Before the Justices of his Lordships County Court of Somersett to be held at Dividing Creek the third tuesday of June then next to answer unto his Said Lordship Concerning a Certain Presentm.t against her found and that thereof he Should not fail &c Att which Said third tuesday of June to witt the twenty first day of the Same month anno Dom one thousand Seven hundred and twenty six being the day of the Return of the Said Writt Cometh the Sherr of Somersett County to whom the foregoeing writt was directed and maketh Return thereof to the Court here Endorsed in these words following vizt Cepi Corpus P Francis Allen Sherr Whereupon the said Elizabeth Ackman in her Own Proper person appears and being by the Sherr Sett to the Barr is thereupon Instantly demanded how she would acquitt herselfe of the premises afd says that of the premisses afd she is guilty thereof and putts herselfe in Mercy of the Lord proprietary but Refuseth to declare ye father of her Child She Stands presented for but is willing to pay thirty shillings for her fines for the fact afd &c Wherefore it is Considered by the Justices here that the Said Eliz.a Ackman be whipt with fined |
