132 premisses by the Court here seen heard and fully understood and the severall allegations as well on ye Part of the said Jane Donelson as on the Part of the ^said^ Petitioner and Likewise the Indenture afd being by the Court Inspected Thereupon it is Considered by the Justices ^here^ that the afd Mary Prue the Petioner from the service of the afd Jane Donelson and Indentures afd be thereof acquitt and that the same Indentures are Insufficient in ye Law to hold the Petitioner afd as a Servant &c
the tenth day of July anno Dom one thousand seven hundred and twenty five at the County afd within the Jurisdiction of this Court did suffer herselfe to begott with Child by a negro against the Peace of the right honrble the Lord proprietary his good Rule and Government and also against the form of the act of assembly in Such Case made and provided &c Whereof the Said Lord proprietary prays advisement of the Court here &c L Gale Clk Jud.cs P Som County Thereupon Command was given to the Sherr of Somersett County that he Should take the Said Martildo Tiror late of Somersett County Spinster if &c to answer &c and afterwards in the Same Court Comes the Said Martildo Tiror in Custody of the Sherr of Somersett County and being by the Sherr putt to the Bar is thereupon Instantly demanded how She would acquitt herselfe of the premisses afd says that of the Premisses afd above Imposed upon her She is noe way Guilty thereof and thereof for tryall she putts herselfe upon the Country and Levin Gale his Lordships attorney who for his Said Lordship in this Behalfe prosecutes Likewise Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to recognize &c because as well &c of which Said Preceipt the said Sherr to witt Francis Allen Gent makes Return that he hath here ready twelve &c as by his preceipt he was Commanded and the Jurors therein Impannelled being Called Came to witt William Lane Edward Crapper, Edward Rownd, James Mumford, John Tull, John Cammell, Thomas Pullett, Mathew Hopkins, Adam Spence Sen.r Robert Hall, Thomas Purnall, Samuel Taylor who being duely Elected tryed and Sworn to Say the truth in the premisses upon their Oath do say that the Said Martildo Tiror did suffer herselfe to be begott with Child by a negro &c Wherefore it is Considered by the Justices here that the Said Martildo Tiror be sold to the bigest bidder for seven years for the use of the County and Likewise the Child so as afd begott of the said Martildo Tiror sold till shall arrive to thirty one years of age for the use afd Thereupon a Certain John Tull of Somersett County Present in Court by Buys the Said Martildo Tiror and Child to serve the said Jn.o Tull his heirs or assignes the full term of time afd In Consideration of the Service afd the Said John Tull is to pay to and for ye use of Somersett County the Sume of two thousand five hundred (and) |
