And the said Giles Bashaw by George Dashiel his attorney Comes and defends the force and Injury when &c and
prays Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the afd
Plft also                 Att which Said Next Court to witt the sixteenth day of Novem anno Dom one thousand
seven hundred and twenty five that Came againe as well the afd Andrew Scott as the afd Giles Bashaw by their
attorneys afd and thereupon the afd Andrew Giles Bashaw by his Said attorney prayed further Leave to
Imparle hereunto untill the next Court and he hath it and the Same day is given to the afd Plft likewise
            Att which said Next Court to witt the fifteenth day of march ann.o Dom one thousand seven
hundred and twenty five Came againe as well the afd Andrew Scott as the afd Giles Bashaw by their attorneys
afd and whereupon the dispute in this action is by the Court and Consent of Partys afd Referred to
John Jones and John Macclester of Somersett County Gent according to the Statute and Judgm.t
to be thereon there return as of this Court &c  And afterwards On the same day and Year Came the
said John Jones and John MccClester the Persons mentioned in the rule of referrence and make return
of their award in the premisses as followeth viz.t  Wee the Said Jn.o Jones and Jn.o MaClester upon
Evidence the amounts between the partys afd do order and adjudge that the said Giles Bashaw
pay unto Andrew Scott two thousand and Sixty good Barrell Staves &c

             Therefore it is Considered by the Court that the afd Andrew Scott Recover against the
afd Giles Bashaw as well the Sum of two thousand and sixty good Barrell Staves his damages afd
760   by the arbitrators afd in form afd found as also the Sum of seven hundred and sixty
pounds of tobo by the Court here adjudged unto him for his Costs and Charges by him about his Suite in this
behalfe Laid Out and Expended & the afd deft in mercy &c

                     W.m Jones Late of Somersett County Gent was attached to answer
unto Isaac Knott of a plea of trespass upon the Case &c
       And Whereupon the Same Isaac ^by^ Levin Gale his attorney Complains that whereas the afd William
the Seventh day of May Anno Dom one thousand Seven hundred and twenty five at Somrsett County
within the Jur of this Court was Indebted to the Same Isaac in the Sum of of four hundred & thirty six
& a halfe pounds of tobacco for work by the same Isaac for the afd William at this Especiall Instance &
Request before that time done & perform'd as by acc.o here within Court b.t may appear & so thereof being
Indebted the Said W.m in Consideration thereof afterwards to witt the same day & year afd in Consideration thereof
at Somrsett County afd within the Jur of this Court upon himselfe assumed & to the same Isaac then & there
faithfully promised that he when afterwards he should be thereto requested the afd sum of four hundred and
thirty six pounds and a halfe of tobo to the same Isaac he woud well & faithfully Content & pay Nevertheless
the said W.m his promis & assumption afd in form afd made not regarding but Plotting and
fraudulently Intending the afd Isaac in that part Craftilly & Subtilly to defraud & Deceive he the afd Sum
of four hundred & thirty Six & a halfe pounds of tobo or any part thereof to the same Isaac (altho' afterwards
to witt eh same day & year afd at the County afd & within the afd Jurisdiction the said W.m was thereto
requested) hath not paid Nor the same Isaac for it in any wise Contented but the said William the
