by Occasion of the premisses afd against the Said James Robertson ought to recover but because
it is not Know what damages the Said Archibald Govan ^hath sustained^ by Occasion of the premisses afd
the Justices here at the prayer of the afd Archibald Govan by his attorney afd do assess the
damages of the afd Archibald Govan according to act of assembly in Such Case made & provided
besides his Costs and Charges to Eleven thousand three hundred and forty two pounds of tobo

             Therefore it is Considered by the Justices here the fifteenth day of March ann Dom
One thousand Seven hundred and twenty five that the afd Archibald Govan Recover against
the afd James robertson as well the Sum of Eleven thousand three hundred and forty two
pounds of tobo his damages by occasion of the premisses afd in form afd ^by the Justices^ assessed as also
394  the Sum of three hundred & ninety four                          Pounds of tobacco by the Court
here adjudged unto the Same Archibald Govan for his Costs and Charges in this behalfe Laid
Out and Expended and ye afd deft in mercy &c

                       Giles Bashaw Late of Somersett County planter was attached
to answer unto Andrew Scott of a plea of trespass upon the Case &c
                      And whereupon the same Andrew by Levin Gale His attry Complaines yt whereas
ye afd Giles ye tenth day of May Seventeen hundred & twenty five at ye County afd within ye Jur of this
Court was Indebted to ye afd Andrew In ye Sum of Two pounds one Shill & two pence Curr mony
for divers goods Wares & Marchandizes before yt time by ye said Andrew at his Especiall Instance
& request sold & Delivered as by acc.t herewith brought into Court may appear & so thereof being
Indebted ye afd Giles In Consideration thereof afterwards to witt ye same day & year afd at ye
at ye County afd within ye afd Jur In Consideration thereof upon himselfe assumed & to ye same
Andrew Scott then & there faithfully promised yt he when afterwards he should be thereto
required he ye afd sum of Two pounds one shill & two pence Currant mony to ye same Andrew
wou'd well & faithfully Content & pay Nevertheless ye afd Giles his promise & assumption afd
in form afd made Little regarding & plotting & fraudulently Intending ye same Andrew
In that part to Defraud he ye afd sum of Two pounds one shill & two pence or any Part thereof
to ye same Andrew hath not paid or him for it in anywise Contented although ye same to Doe
ye said Giles was afterwards thereto by ye same Andrew viz.t ye eleventh day of may in ye year
afd at ye County afd within ye Jur afd requested but ye afd Giles ye same hitherto to pay or ye same
Andrew for it in any wise to Content hath altogether refused & still doth refuse whereby ye
same Andrew says he is worse & hath Damage to ye value of five pounds Curr Mony of maryland
