124 same hethterto to doe hath altogether refused & Still doth refuse wher^e^by the Same Isaac Says he is worse & hath dam to ye value of nine hundred pounds of tob.o and thereof he brings this Suite &c L Gale P Quer pledges &c Jno Doe Rd Roe And the afd William Jones by George Dashiell his attorney Comes and defends the force and Injury when &c and Prays Leave to Imparle hereunto untill the Next and he hath it and the same day is given to the afd Plft also Att which Said Next Court to witt the Sixteenth day of November anno Dom one thousand Seven hundred and twenty five Came againe as well the afd Isaac Knott as the afd William Jones by their attorneys afd and thereupon the Said William Jones by his Said attorney prays further Leave to Imparle hereunto untill ye next Court and he hath it and the same day is given to the afd Plft also Att which Said Next Court to witt the fifteenth day of march anno Dom One thousand Seven hundred and twenty five Came againe as well the afd Isaac Knott as the afd Will.m Jones by their attorney afd and thereupon the Same attorney of the afd William Jones says that he is not Informed by the Same William his Clyant of any Answer for the Same William to the afd Isaac in the plea afd to be given and nothing Else thereof says by which the same Isaac Remains against the afd William in the Plea thereof undefended &c Wherefore the said Isaac Knott his damages by Occasion of the premisses afd against the Said William Jones Ought to recover but because it is not Known what damages the Said Isaac hath Sustained by occasion of the premisses afd the Justices at the prayer of the afd Isaac by his attorney afd and by Consent of the Afd William Jones according to act of assembly in Such Case made and provided do assess the damages of the Said W.m by Occasion of the premisses afd besides his Costs and Charges in this behalfe Laid out & Expended to four hundred thirty Six and a halfe pounds of tobo Therefore it is Considered by the Justices here the fifteenth day of march & Year afd that the afd Isaac Knott Recover against the afd William Jones as well the sum of four hundred thirty six and a halfe pounds of tobo his damages afd in form afd by the 637 Justices assessed as also the Sum of six hundred and thirty seven pounds of tobo by the Court here adjudged unto him for his Costs and Charges by him about his Suite in this Behalfe Laid Out and Expended and ye afd Deft in Mercy &c Pursuant to an act of assembly of this province Now in Force Entituled an act for Regulating of Ordinarys &c the Justices of his Lordship's County Court of Somrsett did assess ^and rate^ the prices of Liquors and accomodations as follows vizt Rum and Country brandy p gallon 8/ or 96 ready Pay If trusted 12/ or 144 Sider and quince drink p gallon 10d or 10 to 14d or 14 white wine Clarett & Port p the bottle 4/ or 48 & so pro rato for a greater or Lesser quanty |
