       March Court                            1725        122

       And Whereupon the same archabald by Levin Gale his attry Complains that Whereas y.e s.d James
the tenth day of June Seventeen hundred & twenty five at Somersett County within the Jur of this Court
was Indebted to the Same Archabald for the Sum of fifty Six pounds fourteen Shill.s & two pence Curr.t mony
for divers goods Waires & Marchantdizes & before that time by the Same Archabold to the Same James Sold & delivered
at the Especiall Instance & request of the same James & for divers sums of mony of the said Archabald
by the same James had before that time at the Especiall Instance & req.t of the Said James as by acc.o here within
Court produced may appear & so thereof being Indebted the Said James in Consideration thereof afterwards that is
to say the same day & year afd at the County afd within the afd Jur upon himselfe assumed & to the same Archabald
then & there faithfully promised that he when afterwards he should be thereto requested the afd sum
of fifty six pounds fourteen Shill.s & two pence Currt mony to the same Archabald wou'd well & faithfully Content
& pay & also that whereas the afd James afterwards to witt the Same day & year afd at the County afd within the
Jur afd was Indebted to the Same Archabald in the Sum of five thousand six hundred & seventy pounds of
tob.o of the value of fifty six pounds ^fourteen shillings and two pence^ Currt mony for Divers Other Goods Wares & Marchantdizes & Divers other
Sums of Mony to the Said James at his Especiall Instance and request before that time by the Said Archabald
sold & delivered & so thereof being Indebted the Same James in Consideration thereof afterwards that is to say
the same day & year afd Last Mentioned at the County afd within the Jur afd upon himselfe assumed & to the
said Archabald then & there faithfully promised that he when afterwards he should be thereto requested the
said Sum of five thousand Six hundred & seventy pounds of tob.o to the Said Archabald would well & faithfully
Content & pay Nevertheless the said James his severell promises & assumption afd in form afd made not
regarding but Plotting & fraudulently Intending the Same Archabald in that part Craftily & Subtilly to defraid
& deceive he the said James the afd Sums of fifty six pounds fourteen Shill.s & two pence Currt mony &
five thousand ^six hundred & seventy^ pounds of tob.o or any part thereof to the same Archabald hath not paid or him for it in any
wise Contented (altho' the same to doe the said James afterwards to witt the Eleventh day of June Seventeen
hundred and twenty five at Somersett County afd within the Jur afd was req.t by the said Archabald) but y.e s.d
James the Same hitherto; the Same to the said Archabald to pay or him for it in any wise to Content hath
altogether refused & Still doth refuse whereby the same Archabald says he is worse & hath damage
to the value of one hundred pounds Curr mony of Maryland and fifteen thousand pounds of tob.o &
thereof he brings this suite &c        L Gale P Quer Pledges &c Jno Doe    Richd Roe

    And the said James Robertson in his Own proper person Cometh and defendeth the force and
Injury when &c and prays Leave to Imparle hereunto untill the next Court and he hath it and
the Same days given to the afd Plft also

    Att which Said next Court to witt the Sixteenth day of November anno Dom One thousand Seven hundred
and twenty five Came againe as well the afd Archibald Govan by his attorney afd as the afd James
Robertson in his proper person and the Said James Robertson thereupon prayed further Leave
to Imparle hereunto untill the Next Court and he hath it and the Same day is given to the afd
Plft also            Att which Said Next Court to witt the fifteenth day of march anno Dom One thousand
Seven hundred and twenty five Came againe the afd Archibald Govan by his attorney afd and
prays that the Said James Robson to his declaration in the plea afd may answer &c  But the Same
James roberton altho' Solemnly ^Called^ Came not but made default whereby the afd Plft remaineth
against the afd Deft thereof undefended &c   Wherefore the said Archibald Govan his damages
