122 And the afd John Cottman by George Dashiell his attorney Cometh and defendeth the force & Injury when &c and prayed Leave thereof to Imparle ^hereunto^ and he had it and the Same day is given to the afd Plft also &c Att which Said Next Court to witt the Sixteenth day of Novem ann.o Dom one thousand seven hundred and twenty five Came againe as well the afd William Fasitt as the afd John Cottman by their attorneys afd and thereupon the afd John Cottman by his said attorney prayed further Leave to Imparle hereunto untill the Next Court and he hath it and the Same day is given to the afd Plft also Att which Said Next Court to witt the fifteenth day of March ann Dom one thousand seven hundred and twenty five Came againe as well the afd William fasitts as the afd John Cottman by their attorneys afd and thereupon the Said Jno Cottman by his Said attorney as before defends the force and Injury when &c and Saith that he is not guilty of the Premisses on him above Imposed and of this he putts himselfe upon the Country Dashiell P Deft Levin and the afd Plft in Like manner L Gale P Quer Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to recognize &.c Because as well &.c of which Said Preceipt the Said Sherr to witt Francis Allen to recognize &c because as well &c the same day and Year Last mentioned makes Return that he hath here ready twelve &c as by his said Preceipt he was Commanded And now hereafterwards to witt the same day and year Came as well the afd Plft as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt Charles Cottingham George Collier, Stephen Horsey Peter Frazer, Moses Duskey ^David Huttson^ Francis Lancake, James Jones, John Shiles, Thomas Humphryes John Aydelott and John Townsend Jun.r who being duely Elected tryed & sworn to say the truth in the premisses upon their Oath do Say that the afd John Cottman is guilty of the premisses as the afd William Fasitt above against him hath Complained and do assess the damages of the Said William by occasion of the premisses afd ^besides his Costs and Charges by him about his suit in ye Part Expended^ to twelve pounds Curr.t mony and for those Costs and Charges to one pound of tobo Therefore it is Considered by the Justices here the fifteenth day of March ann Dom One thousand Seven hundred and twenty five that the afd William Fasitt Recover against the afd John COttman as well the Sum of twelve pounds Curr.t money his damages afd by 1498 the Jurors afd ^in form afd^ assessed as also the Sum of one thousand four hundred & NInety Eight pounds of tobacco to the same William Fasitt at his request for his Costs and Charges by the Court here of Increase adjudged & the afd deft in mercy &c
