       March Court                    1725                 121

       Att which said Next Court to witt the fifteenth day of March Anno Dom one thousand Seven
hundred & twenty five Came againe as well the afd W.m Fausitt as the afd Dennis Hudson by their
attorneys afd and the said Dennis Hutson by his said attorney as before defends the force and Injury
when &c  And says that he is not guilty of the Premisses above upon him Imposed in manner and
form as the the Plft above against him hath Complained and of this he puts himselfe upon the Country
&c      G Dashiell for y.e Deft and the Plft in Like manner        L Gale P Quer

      Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come
here twelve &c by whom &c who neither &c to recognize &c because as well &c of which said Preceipt the
Said Sherr to witt Francis Allen Gent now hereat this day to witt the Same day and Year Last mentioned
makes return of his Said Preceipt that he hath here ready twelve &c as by his Said Preceipt he
was Command and now hereafterwards to witt the Same day and Year Came as well the afd Plft as the
the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Came
to witt Charles Cottingham, Jn.o Waters, Stephen Horsey, Peter Frazer; Moses Duskey, Daniel Maddox
Francis Lancake, James Jones John Shiles, Thomas Humphrys John Aydelott Thos Walker who
being duely Elected tryed and Sworne ^to say the truth in the premises^ upon their Oath do say that the afd Dennis Hutson is guilty of
the trover and Conversion as the Plft above against him hath Complained and the same Jurors doe
assess the damages of the Same Plft by Occasion of the Premisses afd besides his Costs and Charges by him
about his Suite in that part Expended to twelve pounds ten shillings Currt mony of this province and
for those Costs and Charges to one pounds of tobo

                      Therefore it is Considered by the Justices here the fifteenth day of march anno Dom one thousand
Seven hundred and twenty five that the afd William Fasitt Recover against the afd Dennis Hutson
as well the Sum ^of^ twelve pounds ten Shillings Curr.t money of this Province & one pounds of tobo his
damages afd by the Jurors afd ^in form afd^ assessed as also the Sum of One thousand seven hundred and fourteen
1714                pounds of tobo to the same W.m Fasitt at his request for his Costs and Charges by the Court
hereof Increase adjudged and the afd Deft in mercy &c

Somersett County fs    John Cottman Late of Somersett County Millright was attached
to answer unto William Fasitt of a plea of trespass upon the the Case &c
And whereupon the same William by Levin Gale his attorney Complaines that whereas
                   the afd John useing the trade or Occupation of a mill right the tenth day of Novem Anno
Dom One thousand Seven hundred and twenty four at Somersett County afd within the Jurisdiction
of this Court promissed y.e said William Artificially & as a good & Well Skilled workman to Build y.e Said
Wm upon y.e then dwelling Plantation of y.e said William at Somrsett County afd within y.e afd Jur of a Certain
Materialls fitt for that purpose which y.e Said W.m then & there had A good & sufficient Grist Wind Mill
Nevertheless y.e Said John afterwards to witt y.e same day & year afd at y.e County afd within y.e afd Jur
of y.e afd Materialls of y.e Said W.m upon y.e afd Dwelling plantation of y.e Same W.m A Wind Grist mill
so In artificially did build yt by y.e Carelesness & Ingnorance of y.e Said John in building thereof y.e Said
Mill & y.e Meterialls afd were wholey spoiled by means whereof y.e Same W.m says he is worse & hath
dam to y.e value of thirty pounds Curr.t mony of maryland & thereof he brings this Suite &c
