12 and twenty four at the County afd within the Jurisdiction of this Court was Indebted unto the afd Robert the sum of Five barrells of good sound Indian Corn and five hundred pounds of tobacco as by a note herewith in Court produced may appear and soe thereof being Indebted the Same Daniel in Consideration thereof afterwards to witt the day and year afd at the County afd within the Jurisdiction afd upon himselfe assumed and to the same Robert then and there faithfully promised that he when afterwards when he should be thereto requested he would well & faithfully Content and pay. Nevertheless the afd Daniel his promise & assumption afd in form afd made Little regarding And plotting and fraudulently Intending the afd Robert in that part to defraud and deceive the afd sums of five barr.lls of good sound Indian Corn and five hundred pounds of tobacco or any part thereof to the same Robert hath not paid or him for it in anywise Contented altho' often Requested afterwards to witt the tenth day of November Seventeen hundred & twenty four at the County afd within the Jurisdiction afd but the same hithterto to the same Robert to pay hath altogether refused and still doth refuse whereby the same Robert says he is the worse and hath damage to the value of one thousand pounds of tobacco & tenn Barrells of Corn and thereof he brings this suite &c Levin Gale P Quer Pledges &c Jno Doe R Roe And the afd Daniel Burgin in his Own proper person Comes and defends the force & Injury when &c and Saith that he Cannot Gainsay the plft his action afd so as afd against him brought nor Can he say but that the said plft ought to Recover his damages by occasion of the premisses afd to five Barrells of Indian Corn and five hundred pounds of tobacco and Costs of Suite against him which the Said plft doth not Gainsay &c Therefore it is Considered by the Court here the sixteenth day of March ann Dom one thousand seven hundred & twenty four that the afd Robert Maycomb Recomb Recover against the afd Daniel Burgin as well the sum of five barrells of good Indian Corn & five hundred pounds of tobo his damages by occasion of the premisses afd as al in form afd Confesed as also the Sum of (225) Two hundred & Twenty five pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his Suite in this Behalfe Laid Out and Expended & the afd Daniell Burgin in Mercy &c
