the County afd within the Jurisdiction of this Court was Indebted unto the afd John Pitts in the
Sum of Nine hundred and Seventy pounds of tobacco for divers goods wares & Merchandizes
to him sold and delivered and so thereof being Indebted the Same Thomas in Consideration
thereof afterwards to witt the day and Year afd at the County afd within the Jurisdiction afd
upon himselfe assumed and to the Same John Pitts then and there faithfully promised that he
the Said Thomas the afd Nine hundred & Seventy pounds of tobacco to the afd John Pitts when
afterwards he should be thereunto Requested he would well and faithfully Content & pay
Nevertheless the said Thomas Layfeild his promise and assumption afd in form afd made
Little Regarding and plotting and fraudulently Intending the afd John Pitts in that part Craftilly
and Subtilly to defraud & deceive the afd Nine hundred & Seventy pounds of tobacco or any
part thereof to the afd John Pitts altho' afterwards to witt the tenth day of June Seventeen hundred
& twenty three at the County afd within the Jurisdiction afd was thereunto Requested hath
not paid him for it ^or^ in anywise Contented to the damage of the same John Eighteen hundred
pounds of tobacco tobacco and thereof he brings this Suite &c    L Gale P Quer Pledges &c Jn Doe
                                                                                                                                              R Roe

                And the afd Thomas Layfeild in his Own proper person Cometh and defendeth fo
the force and Injury when &c and prayeth Leave to Imparle hereunto untill the next Court
and he hath it and the same day is given to the afd John Pitts also

                Att which said Next Court to witt the sixteenth day of March Anno Dom One thousand seven
hundred & twenty four Came againe as well the afd John Pitts by his attorney afd as the afd Thomas
Layfeild in his Own proper person and the Said Thomas Layfeild saith that he Cannot
gainsay the action afd of the afd John Pitts so as afd against him brought nor Can he Say
but that the said John Pitts Ought to Recover his damages by Occasion of the premisses
afd to Nine hundred & Seventy pounds of tobacco & Costs of Suite against him which the
said plft doth not gainsay &c

                Therefore it is Considered by the Court here the same day and year last
mentioned that the afd John Pitts Recover against the afd Thomas Layfeild as well
the sum of Nine hundred and Seventy pounds of tobo his damages afd in form afd Confesed
(302)    as also the Sum of three hundred and two                              pounds of tobacco by the
Court here adjudged unto him for his Costs and Charges by him about his Suite in this behalfe Laid
out & Expended & the afd Thos Layfeild in Mercy &c
