11 Anno Dom One thousand Seven hundred & twenty four Came again as well the afd William Whittington as the afd John Olandman by their attorneys afd and the same attorney of the afd John Olandman saith that he is not Informed by his Clyant of any answer for the same John to the afd William the plea afd to be given and nothing Else thereof saith by Which the same William Remains against the afd John thereof undefended &c Wherefore the afd William Whittington his damages by occasion of the trespass afd ^against the afd John Olandman^ Ought to Recover but becaus it is not Known to the Court of the Right honrble the Lord proprietary what damages the afd William hath sustained as well by occasion of the trespass afd as for his Costs and Charges by him about his Suite in that part Expended Therefore Command is Given to the Sherr is giv of Somersett County that by the Oath of honest and Lawfull ^men^ of his Bailywick or County he deligently Inquire what damages the afd William Whittington as well by Occasion of the trespass afd as for his Costs and Charges by him about his Suite in that part sustained and the Inquisition which thereof he should take to the ^his Lordships^ County Court to be held for the County of Somersett at dividing Creek the third tuesday of march then next under his seale and the seals of those by whos oath ^makes ye same Inquisition^ And send with his Lordships writt ^that^ thereof to him directed And the same day is Given to the afd William There also Att which said third tuesday of march to witt the sixteenth day of the same Month ann Dom One thousand seven hundred and twenty four before the Justices of his Lordships County Court of Somersett held at dividing Creek ^for the County afd^ Cometh the afd William Whittington by his attorney afd and the sherr to witt Joseph MccClester Gent returned a Certain Inquisition before him taken at Snow hill in allhollows parish in the County of Somersett the twenty third day of February ann Dom One thousand Seven hundred & twenty four by which it appears that the afd William sustained damages by occasion of the trespass afd besides his Costs and Charges by him about his Suite in that part Expended to fourteen pounds Curr.t money of this Governm.t and for his ^same^ Costs and Charges to twenty five shillings like money Therefore it is Considered by the Court here the sixteenth day of March Ann Dom One thousand seven hundred & twenty four that the afd William Whittington Recover against the afd John Olandman as well the sum of fifteen pounds five shillings Curr.t money of this Government his damages afd as by 1056 the Inquisition above appears as also one thousand and fifty six pounds of tobo for his Costs and Charges by him about his Suite in that part Expended the afd William by the Court of the Right honrble the Lord proprietary now here at his request of Increase adjudged and the afd W John Olandman in Mercy &c
