Aa Copy of the foregoing decl and acc.t was made & sent to be served on the Deft with the writt in the plea afd At.a Att which said third tuesday of March to witt the fifteenth day of the same Month anno Dom one thousand seven hundred & twenty five being the day of the return of the said Writt Comeeth ^the said Jos: McClester^ Peter Whiting by his attry afd & ye sherr of Somrsett County to whom the foregoing Writt was directed Likewise Cometh and maketh return hereof ^to^ the Court here Endorst vizt Cepi Corpus decl delivd in time Fran: Allen Sherr And whereupon the Said Price Collins by Ebenezer Cook his attorney Comes and defends the force and Injury when &c and says that he Cannot gainsay the Plft his action afd against him brought nor Can he Say but that the Said Plft Ought to recover his damages by Occasion of the premisses afd to two thousand two hundred and f Eight pounds of tobo and Costs of Suite against him which the Said Plft doth not gainsay &c Therefore it is Considered by the Justices here the fifteenth day of march anno Dom One thousand Seven hundred and twenty five that the afd Joseph MccClester Recover against the afd Price Collins as well the Sum of two thousand two hundred and Eight pounds 364 of tobo his damages afd in form afd Confessed as also the Sum of Three hundred and sixty four pounds of tobo by the Court here adjudged unto him for his Costs and Charges by him about his Suite in this Behalfe Laid Out and Expended & ye afd deft in mercy &c
his Lordships County Court of Somersett to be held at Dividing Creek the third tuesday of march then next to answer unto Joseph MccClester of a plea of trespass upon the Case &c and that thereof he Should not &c And the Said Joseph MccClester by Levin Gale his attorney proceeded against the said Joy Hobbs in the plea afd as follows vizt Somrsett fs Joy Hobbs Late of Somrsett County Cooper was attached to answer unto Joseph (MccClester) |
