113 March Anno Dom One thousand Seven hundred and twenty five that the afd Peter Whiting have Execution against the afd Thomas Layfeild ^of the Judgmt afd^ for as well the Sum of six pounds Curr.t money of Vergenia his ^Certain^ damages afd as also the Sum of three hundred and Nine pounds of tobo Costs of Suite in the Judgm.t afd specifyed as also 221 the sum of Two hundred and Twenty one pounds of tobo by the Court here adjudged unto him for his Costs and Damages sustained by Occasion of Delay of Execution of the Judgm.t afd &c
of trespass upon the Case &c and that thereof he Should not fail &c And the Said Joseph MaClester by Levin Gale his attorney declared against the said Price Collins in the Plea afd as followeth vizt Somersett fs Price Collins Late of Somersett County planter was attached to answer unto Joseph Macclester of a plea of trespass upon the Case &c And Whereupon the Same Jos: by Levin Gale his attry Complains that whereas the afd Price the tenth day of Decem Seventeen hundred & twenty five at the County afd within the Jur of this Court was Indebted to to the same Jos: in the Sum of three thousand & sixty d pounds of tob.o as by ac.t herewithin Court brought may appear & so thereof being Indebted the same Price in Consideration thereof afterwards to witt the Same day & year afd at the County afd within the afd Jur upon himselfe assumed & to the same Jos: then & there faithfully promised that he when afterwards he should be thereto requested he the afd Sum of three thousand & sixty pounds of tob.o to the same Jos: he would Well & faithfully Content & pay nevertheless ye ^same^ Price his promis & assumption afd in form afd made not regarding & plotting & fraudulently Intending the afd Jos: in that part Craftily & Subtilly to deceive & defraud he the afd Sum of three thousand and Sixty pounds of tob.o or any part thereof to the same Jos: (altho' the said Price afterwards to wit the same day & year afd at the County afd within the afd Jur was by the same Joseph thereto requested) hath not paid or him for it anywise Contented but the same Price the same hitherto to do hath altogether refused & Still doth refuse whereby the same Jos: says he is wors & hath Damage to the value of Six thousand pounds of tob.o & thereof he brings this Suite &c L Gale P Quer pledges &c Jno Doe Richd Roe
