MaClester of a plea of trespass upon the Case &c

          And Whereupon the same Joseph by Levin Gale his attry Complains that whereas
the Said Joy Hobbs the tenth day of Decem one thousand Seven hundred & twenty five
at the County afd within the Jur of this Court was Indebted to the same Jos: in y.e sum of fourteen
hundred & eight pounds of tob.o as by act herewithin Court produced may appear and
thereof being Indebted the af.d Joy Hobbs in Consideration thereof afterwards to witt the same
day & year afd at the County afd W.thin the Jur ofd upon himselfe assumed & to the same Jos:
then & there faithfully promised that he when afterwards he should be thereto required he the
afd Sum of fourteen hundred & eight pounds of tob.o to y.e Same Jos: would well & faithfully
Content & pay never theles the S.d Joy Hobbs his promis & assumption afd in form afd made
not regarding but Plotting & fraudulently Intending the same Joss in that part to defraud
& Deceive y.e s.d Joy Hobbs the said Sum of fourteen hundred & eight pounds of tob.o or any part
thereof hitherto to the same Jos: (altho' often by the same Jos: thereto required afterwards vizt)
upon the afd tenth day of Decem in year afd at Somersett County afd within the Jur afd) hath
not paid or the same Joseph for it in any wise Contented but the afd Joy Hobbs the same hitherto
to pay or the same Jos for it anyway to Content hath altogether refused & Still doth refuse
Whereby the same Jos: says he is wors & hath Damages to the value of three thousand pounds
of tob.o and thereof he brings this Suite &c             Levin Gale P Quer pledges &c     Jno Doe
