113 of Coventry Parrish in the County afd Gent as well the Sum of Six pounds Currt money of Virginia Certain Damages as also the Sum of three hundred & ninty pounds of tob.o by the Same Court unto the said Jeffry were adjudged for his Costs & Charges by him about his Suite in that part Expended &c Whereof he is Convict ^as^ by the records and process thereof in our Court before our Justices remaineth Manifestly appeareth and afterwards the afd Jeffery Flowers died intestateastis said after whose death administration of all & singular the goods Chattells rights & Creditts which were of the afd Jeffery Flowers at ye time of his death to Peter Whiting of ye Colony of Verginea in due form of Law was Committed as by the Letters of administration herein our Court before us will appear as on the part of the afd Peter Whiting in our Court we have rec.d and altho Judgmt be thereupon rendred Nevertheless Execution of the Damages & Costs afd to him as yett remaineth to be done to the hind scire of the Execution of the administration afd Whereupon the same PEter Whitting hath supplicated us for a proper remedy in that part to him to be provided & we being willing that those things which in our Said Court are rightfully done should be duly Executed We Command you that by good & Lawfull men of your Bailywick you make Known unto the afd Tho.s Layfield that he be & appear before the Justices of our County Court to be held att Dividing Creek in Somrsett County afd the third tuesday of march next to shew Cause of anything for himself he hath or to say Knoweth where^fore^of the afd Peter Whiting Execution against him of the ^damages and^ Costs afd to have ought not according to the form of the recovery afd if unto him it Shall Seem Expedient & have you on their & there the names of those by whom you make the same Known & this writt Wittness Sam.ll Hopkins Gent Chiefe Justice of our Said Court the 19.th day of Novem in the 10.th year of our Dominion &c Anno Dom 1725 Tho.s Hayward Cl Issued Fbry 14.th 1725 Att which said third tuesday of March to witt the fifteenth day of the Same month ann.o Dom one thousand Seven hundred and twenty five being the day of the return of the said Writt Cometh ye sd Peter Whiting by his attry afd and the Sherr of Somersett County to whom the foregoing Writt was Directed Likewise Cometh & maketh return thereof to the Court here Endorst viz.t made Known P Fran Allen Sherr Whereupon the Said Peter Whiting adm.rs as afd by his attorney afd prays that the afd Thomas Layfeild to his writt of Scire facias afd may answer but the said Thomas Layfeild altho' Solemnly Called Came not but made Default whereby the said Plft remains against the afd deft thereof undefended &c Therefore it is Considered by the Justices here the fifteenth day of (march) |
