112 the third tuesday of March next If anything for herselfe she hath or knoweth to say wherefore the afd Benjamin Wailes his Execution ag.t her the said Ann Renshaw of the debt & Costs afd (of the goods of the afd Jn.o Renshaw at the time of his death remaining to be administred if she shall have so much thereof & if not &c then the Costs afd of the proper Goods and Chattells of the said Ann Renshaw to be Levied) to have ought not according to the form of the recovery afd if to her it Shall seem Expedient and have you then & there the names ^of those^ by Whom you make the Same known & this Writs Wittness Samll Hopkins Gent Chief Justice of our said Court the 19.th day of Novem in the 10th year of our Dominion &c Anno Dom 1725 Issued Febry 8: 1725 Thomas Hayward Cl Att which said third tuesday of March to wit the fifteenth day of the same Month anno Dom one thousand Seven hundred & twenty five being the day of the return of the said writt Cometh ye s.d Benj.a Wailes by his Attry afd & the Sherr of Somersett County to whom the foregoing Writt was directed Likewise Cometh & maketh return thereof to the Court here Endorst in these words following vizt made Known p Fran: Allen Sher And the Said Benjamin Wailes by his attorney afd prays that the said Ann Renshaw to his dec Scirefacias as afd may answer &c But the Said Ann Renshaw altho Solemnly Called Came not but made default whereby the Same Plft Remains against the afd deft wholly undefended &c Therefore it is Considered by the Justices here that the afd Benjamin Wailes have his Execution against the afd Ann Renshaw ^admrx as afd^ of the Judgmt afd as well the Sum of One thousand One hundred and Ninty One pounds of tobo his debt afd as also the the Sum of two hundred and Nineteen pounds of tobo Costs of Suite in the Judgmt afd Specifyed as also the Sum of Two hundred and Nine 209 pounds of tobo by the Court here adjudged unto him for his Costs and damages sustained by Occasion of Delay of Execution of the Judgmt afd to be Levied of the goods and Chattells which were of the said John Renshaw at the time of this death remaining to be administred in the hands of the Said Ann Renshaw admrx as afd if so much thereof in her hands she should have &c and if so much thereof in her hand she should not have then the Costs afd to be Levied of the Proper goods and Chattells of the said Ann Renshaw &c
here (to witt) the Sixteenth day of Novem anno Dom one thousand Seven hundred & twenty four before the Worshipfull Sam.ll Hopkins Gent And his associates then Justices of our said Court & by Consideration of the same Court (at Dividing Creek) recovered against Tho.s Layfield Late (of) |
