109 a Copy of the foregoing Decl was made & Sent to be Served on the Deft with the Writt ^in the^ plea afd at which said third tuesday of march to witt the fifteenth day of the Same month anno Dom one thousand seven hundred and twenty five being the day of the return of the said Writt Cometh the Said Benjamin Wailes by his attorney afd and the Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words viz.t Non est Inventus P Fran Allen sherr Whereupon the said Benjamin Wailes by his attorney afd prays that for as much as he hath Complyed with the Law in Order to an attachm.t he may have Judgm.t against the Said Michael Holland for the damages afd by way of attachm.t according to act of assembly &c whereupon for that it Seems to the Court here that the Said Benjamin Wailes hath Complyed with the Law as alledged &c Therefore it is Considered by the Justices here that the afd Benjamin Wailes Recover against the afd Michael Holland as well the Sum of One thousand and sixty pounds of tobo his damages by Occasion of the premisses afd as all Costs and Charges 230 by the Said Plft Laid Out and Expended about his Suite by way of attachm.t against the goods Chattells or Creditts of the Said Michael Holland according to act of assembly in Such Case made and provided &c
Brittingham at the Prayer of the Plfts attorney is adjudged to give Speciall Baile to the action afd Thereupon a Certain Abraham Smith and Price Collins both of Somersett County Gent Present herein Court undertakes for the Said Isaac Brittingham that if In Case the Said Benjamin Wailes Shall recover Judgm.t in the Plea afd ^against the said Isaac Brittingham^ or that the Said Isaac Brittingham Should be therein Convict that then he the Isaac Brittingham Shall pay the Condemnation of the Court thereupon or Render his body to the Custody of the Sherr of Somersett County in Satisfaction thereof or that they the Said Abraham Smith and Price Collins will doe it for him &c
who as well &c he owes & unjustly detains &c And whereupon the Same John Dolenson who as well &c by Levin Gale his attry saith that whereas by an Act of Assembly of this province Entituled an Act relating to Servants and Slaves made at a session of assembly began & held at the Citty of Anapolis the twenty sixth day of Aprill one thousand Seven hundred & fifteen amongst other things therein Contain'd it stands Enacted by the authority of the s.d Assembly y.t any person or persons whatsoever that (shall) |
