fifteenth day of march ann Dom One thousand Seven hundred and Seventy five that the afd
Benjamin Wailes Recover against the afd Jno Taylor as well the Sum of Nineteen hundred
and Ninty Six pounds of tobo his debt afd as also the Sum of Two hundred and Ninety six
296            pounds of tobo for his Costs and damages Sustained by Occasion of the detaining
of the same debt to the same Benjamin Wailes of his assent by the Court here adjudged
and the afd deft in Mercy &c    Memorand.m the Plft Releaseth out of the Debt afd fourteen
hundred and fifty ^one^ pounds of tobo &c

Michael Holland
 Command was given to the Sherr of Somersett Coun that he should take
Michael Holland Late of Somersett County Mariner if he should be found
in his Bailywick and him Should Safe Keep so that he Should have his
       body Before the Justices of his Lordships County Court of Somersett to be held at Dividing
       Creek the third tuesday of March then next to answer unto Benjamin Wailes of a plea
       of trespass upon the Case &c   And that thereof he should not fail &c

                   And whereupon the Same Benjamin Wailes by Levin Gale his attorney Complaines
       that whereas the afd Michael Holland the thirtieth day of Decem Seventeen hundred
       and twenty five at the County afd within the Jur of this Court was Indebted to the afd Benj.a
       in the Sum ^or^ of Quantity of one thousand ^and^ Six^ty^ Pounds of tob.o as by a note hereof in Court
       brought Signed by the said Michael may appear and so thereof being Indebted the afd
       Michael in Consideration thereof afterwards to wit the same day and year afd at the
       County afd within the afd Jur in Consideration thereof upon himselfe assumed & to the
       Same Benj.a then and there faithfully promised that he when afterwards he should be
       thereunto required he the said Sum ^of^ or Quantity of one thousand ^sixty^ pounds of tob.o to the
       said Benjamin Wailes would well & faithfully Content & pay Nevertheless the afd
       Michael his promis and assumption afd in form afd made Little regarding & plotting and
       fraudulently Intending the same Benjamin in that part to Defraud the bill afd sum
       of one thousand & Sixty pounds of tob.o or any part thereof to the same Benja Wailes
       hath not paid or him for in it anywise Contented altho the same to doe the said Michael
       was afterwards by the same Benjamin viz.t the thirty first day of July in the year afd
       at the County afd within the ^Jur^ afd was requested but the afd Michael the same hitherto
       to pay or the same Benjamin for it anywise to Content hath altogether refused
       and Still doth refuse Whereby the same Benjamin Wailes Say he is worse
       and hath Damage to the value of two thousand Pounds of tobacco and thereof
       he brings this Suite &c                           Levin Gale P Quer pledges &c Jno Doe R.d Roe
