Occasion of the non performance of the promiss and assumption afd besides his Costs and Charges in this behalfe
Laid Out and Expended to thirteen hundred and Sixty EIght pounds of tobo

          Therefore it is Considered by the Justices here the fifteenth day of March anno Dom One thousand
Seven hundred and twenty five afd that the afd Thomas Dashiel Recover against the afd Ann Renshaw
as well the Sum of thirteen hundred and ^Sixty Eight^ thirty six pounds of tobo his damages by Occasion of the premisses
261   afd in form afd by the Justices assessed as also the Sum of Two hundred & Sixty One
pounds of tobo by the Court here adjudged unto him for his Costs and Charges by him about his suite in this
behalfe Laid Out and Expended and the afd Deft in Mercy &c

 Command was given to the Sherr of Somersett County that he Should take the
Ann Renshaw Late of Somersett County Spinster if She Shall be found in his
Bailywick and her ^should^ Safe Keep so that he might have her Body before the Justices
of his Lordships County Court of Somersett to be held at dividing Creek the
                         third tuesday of March ^then^ Next to answer unto Mary Martin Executrix of the Last will &
testament of Robert Martin Late of Somersett County dec.d of a plea of trespass upon the Case &c  and
that thereof he Should not fail &c                   And the Said Mary Martin Executrix as afd by her attorney
declared against the Said Ann Renshaw in the plea afd as followeth viz.t

Somersett fs      Ann Renshaw Late of Somersett County Spinster was attached to answer unto Mary
Martin Executrix of the Last will and testament of Robert Martin Late of Somersett County dec.d of
a plea of trespass upon the Case &c       And whereupon the Same Mary by Levin Gale her attorney
Complains that whereas the afd Ann the tenth day of May Seventeen hundred & twenty four att
Somersett County afd within the Jur of this Court was Indebted to the same Robert in his Life
time in the Sum of thirteen hundred & eleven pounds of tob.o as by acco.t herewithin Court prod^u^ced
May appear & so thereof being Indebted the Said Sum in Consideration thereof afterwards to witt
the Same day and Year afd at the County afd within the Jur afd upon himselfe assumed & to ye same
Robert in his Life time then & there faithfully promised that she when afterwards she should be
thereto requested that the Sum of thirteen hundred & Eleven pounds of tobo to the said Rob.t would
well & faithfully Content & pay Nevertheless the said Ann her promise & assumption afd in form
afd made Little regarding & plotting & fraudulently Intending the same Rob.t in his Life time & the afd
Mary Since his death to whom execution of the Last will & testament of the same Rob.t Since his death
was in due form of Law Committed in this part Craftily & Subtilly to defraud & deceive the ye s.d Ann
the afd Sum of thirteen hundred & Elevin pounds of Tob.o to the afd Robert in his Life time or the afd
Mary Since his Death hath not paid or Either of them for it in any wise Contented altho the said
Ann the SAme to doe afterwards viz.t the tenth day of June Seventeen hundred & twenty four by
the said Robert in his Life time & the tenth day of June Seventeen hundred & twenty five by ye sd
Mary Since his death was at the County afd afd within the Jur afd there to requested but the the s.d
Ann the Same hetherto to pay hath altogether refused & Still doth refuse whereby
the said Mary Says that She is wors & hath dam to the value of three thousand pounds
