A Copy of the foregoing declaration & acc.t was made & sent to be Served on ye Deft with the will
in the place afd   Att which said third tuesday of March to witt the fifteenth day of the Same
month being the day of the return of the said writt ann Dom on thousand Seven hundred
and twenty five Cometh the said Mary Martin Exrx as afd by her attry afd & ye sherr of
Somersett County to whom the foregoing Writt was Directed Likewise Cometh & maketh
Return thereof to the Court here Endorsed viz.t   Cepi Corpus & decl delivered the
Deft in time P Francis Allen Sherr

          And the afd Ann Renshaw by Joseph Pemberton her attorney Cometh and defendeth
the force and Injury when &c and the said Mary Martin Executrix as afd by her attorney
afd prays that the Said Ann REnshaw to her declaration in the plea afd my answer &c
    But the Same attorney of the afd Ann Renshaw says that he is not Informed by ye
same Ann his Clyant of any answer for the same Ann to the afd Mary in the plea afd
to be given and nothing Els thereof sayth by which the afd Mary remains against the
afd Ann thareof undefended &c    Whereupon the said Mary Martin her damages by
Occasion of the non performance of the promise and assumption afd against the said
Ann Ought to recover but because it is not Known what damages the Said Ann
Mary hath sustained by Occasion of the Non performance of the promise and assumption
afd the Justices here according to act of assembly in Such Case made and provided at the
prayer of the said Mary by her attorney afd do assess the damages of the Said Mary by occasion
of the Premisses afd to the besides her Costs and Damages Charges to thirteen hundred
and Eleven pounds of tobo
                                               Therefore it is Considered by the Justices here that the
afd Mary Martin Exrx as afd recover against the afd Ann Renshaw as well the Sum
