Content & pay Nevertheless the afd Ann her promis & assumption afd in form afd made
Little regarding and plotting and fraudulently Intending the same Thomas in that
part to defraud she the afd Sum of thirteen hundred & Sixty Eight pounds of tobacco
or any part thereof to the same Thomas Dashiell hath not paid or him for it in
anywise Contented altho' the same to doe the said Ann Renshaw was thereto afterwards
by the same Thomas viz.t the tenth day of July in the year afd at ye County afd
within the Jur afd requested but the afd the same hitherto to pay or the same for it In
anywise Contented hath altogether refused and Still doth refuse whereby the same
Thomas says he is wors and hath Damage to the value of three thousand pounds
of tob.o  And thereof he brings this Suite &c          Levin Gale P Querr pledges  Jno doe

             A Copy of the foregoing Declaration ^and Account^ was made and Sent to be Served on the Deft with
             the writt in y.e plea afd      Att which said third tuesday of March to witt the fifteenth day
             of the same Month being the day od the return of the said Writt ann Dom one thousand
             Seven hundred & twenty five Cometh the said Tho.s Dashiell by his attry afd & ye sherr of
             Somersett County to whom the foregoing writt was Directed Likewise Cometh & maketh
             Return thereof to the Court here Endorsed viz.t  Cepi Corpus ^and decl delivered the deft in time^ P Francis Allen Sherr

                   And the Said Ann Renshaw by Joseph Pemberton her attorney Comes and defends the force and
             Injury when &c and the afd Thomas Dashiell by his attorney afd prays that the afd Ann Renshaw
             to his declaration in the plea afd may answer but the Same attorney of the afd Ann Renshaw saith
             that ^he^ is not Informed by the Same Ann his Clyant of any answer for the Same Ann to the afd
             Thomas to be given in the Plea afd and nothing Els thereof Says by that the Same Thomas remains
             against the afd Ann thereof undefended &c                Whereupon the Said Thomas Dashiell his
             damages by occasion of the Non performance of the promise and assumption afd against the
             Said Ann Renshaw ought to recover but because it is not Known what damages the Said Tho.s
             hath Sustained by occasion of the Non performance of the promise and assumption afd the Justices
             of his Lordships County Court of Somersett at the prayer of the Said Thomas by his attorney afd
             according to act of assembly in Such Case provided do assess the damages of the said Thomas by
